Why Maloos still not booked for confronting woman cop on duty?

Nagpur: Legal experts are baffled by Nagpur Police’s refusal to register a fresh offence against members of Maloo family on charges of obstructing a public servant from discharging duty, when they confronted a woman cop at their Deshpande Layout residence on Friday.
While police are giving a long rope to Maloos for reasons best known to them, the prosecution is repeatedly raising the issue in court, while demanding cancellation of her bail for non-cooperation in the investigation process.The incident, which is recorded in Tehsil police station diary, was repeatedly highlighted by the public prosecutor on Monday, but Nagpur Police has shockingly refused to take cognizance.


The family tried to deter the Tehsil police team from serving the court notice directing Ram Jhula accident case key accused Ritika Maloo to remain present during the hearing. Though the family relented after a high-voltage drama, Ritika has twice remained absent from court hearings.
Sources stated no offence was registered against the Maloos at Nandanvan police station, while legal experts stated there is no hurdle to initiate action.
“The act of obstructing police officers which included charging at a woman cop and trying to snatch her cell phone constituted an offence under Section 132 of Bharatiya Nyaya Sanhita (BNS). The crime is even more serious as cops had gone to serve a court’s notice, which is also denial of rendering due dignity to a judicial officer, who had issued the notice,” said a legal expert on condition of anonymity.
While a section of society is raising questions of parity, police are being viewed as the protector of the rich and resourceful, say experts. “Police would not have extended immunity to a commoner who would have refused to accept a court notice. Here the police brass is failing to shield its own force who were humiliated by the accused's family,” said an activist.
