When I was in High School, I would drive on John Voster road everyday on my way to Southdowns College and see the uniquely shaped buildings that I drove past. I was a young man looking up at these buildings in awe and admiration of the founders that created such incredible institutions. Little did I know that in 2024, I would attend Spoor & Fisher’s Intellectual Property Day in those very same buildings. I am deeply grateful to have attended Spoor & Fisher’s IP Day where we delved into the world of IP; the intricacies around it and moulding the future thereof. A huge thank you to Phegello Harold Mdlalose and his wonderful team for hosting such an informative and enjoyable day for all of us. It was a pleasant suprise to share in the day with fellow University Of Pretoria, Faculty of Law students Amukelani Nhlapo and Muhammed Samaria as well as meeting future legal practioners from around the country like Amory Smith. With our current demand of AI, the intellectual property surrounding it remains exciting. There is no doubt that the future is already here and Spoor & Fisher are ahead of it.

However, influencer marketing isn't without its challenges, and comes with risks of trademark or copyright infringement. As influencer marketing continues to grow, it's crucial for both brand owners and influencers to comply with relevant legislation and advertising regulations. Did you know? Appendix “K” of the Advertising Regulatory Board Code includes a Social Media Code specifically for social media marketing. This code: ✔ Requires influencers to disclose paid social media advertising using recognized identifiers. ✔ Places responsibility on the brand owner to have a written contract with any paid influencer, including specific information. https://lnkd.in/g8sq_tim From cutting edge to old school, Millie Ward speaks to contributors to the latest edition of WTR’s Anti-counterfeiting and Online Brand Enforcement Guide about their top strategies to mitigate against the ever-growing threat posed by tech-savvy counterfeiters. Maia Woodhouse and Kristina Montanaro Schrader of Adams and Reese LLP explore the inevitable vulnerability that accompanies big-name retailers opening up their online platforms to third-party sellers, while Cesare Galli of IPLAWGALLI highlight the increasing length that counterfeiters are going to target consumers, including hidden links to secondary sites. According to Georgina Danzig of Heer Law - Intellectual Property Law and Litigation, these malicious tactics are growing increasingly sophisticated, allowing criminals to evade detection and limit liability. When it comes to countering these efforts, Davide L. Petraz and Daniele Petraz of GLP Intellectual Property Office advocate for the use of AI to review current anti-counterfeiting tools; brand owners should also make use of data analytics to analyse and interpret patterns, suggest Alan Chiu, James Choi, Nicole Huo and Nicola Kung of ELLALAN. In terms of taking concrete action against the trade in fakes, Saif Khan and Meghana Kudligi of Anand and Anand point towards blockchain-based solutions. Rafael Lacaz Amaral and Raquel Corrêa Barros of Kasznar Leonardos are fans of digital authentication technologies, including holograms and RFID tags, with Dr. Reinhard Fischer and Tamara Moll LL.M. of COHAUSZ & FLORACK also speaking highly of nano-optics, particularly when it comes to the fashion industry. But while it’s crucial to keep up with the latest tech, it’s just as vital to remember the tried and tested building blocks of any anti-counterfeiting strategy worth its salt, says Michael L. of Spoor & Fisher, who warns brand owners to remember the value of education as to the very real risk posed by fakes.
