Maia Woodhouse and Kristina Montanaro Schrader of Adams and Reese LLP explore the inevitable vulnerability that accompanies big-name retailers opening up their online platforms to third-party sellers, while Cesare Galli of IPLAWGALLI highlight the increasing length that counterfeiters are going to target consumers, including hidden links to secondary sites. According to Georgina Danzig of Heer Law - Intellectual Property Law and Litigation, these malicious tactics are growing increasingly sophisticated, allowing criminals to evade detection and limit liability. When it comes to countering these efforts, Davide L. Petraz and Daniele Petraz of GLP Intellectual Property Office advocate for the use of AI to review current anti-counterfeiting tools; brand owners should also make use of data analytics to analyse and interpret patterns, suggest Alan ChiuJames Choi, Nicole Huo and Nicola Kung of ELLALAN. In terms of taking concrete action against the trade in fakes, Saif Khan and Meghana Kudligi of Anand and Anand point towards blockchain-based solutions. Rafael Lacaz Amaral and Raquel Corrêa Barros of Kasznar Leonardos are fans of digital authentication technologies, including holograms and RFID tags, with Dr. Reinhard Fischer and Tamara Moll LL.M. of COHAUSZ & FLORACK also speaking highly of nano-optics, particularly when it comes to the fashion industry. But while it’s crucial to keep up with the latest tech, it’s just as vital to remember the tried and tested building blocks of any anti-counterfeiting strategy worth its salt, says Michael L. of Spoor & Fisher, who warns brand owners to remember the value of education as to the very real risk posed by fakes.
