We recently successfully represented The Global Fund to fight AIDS, Tuberculosis and Malaria - an international organisation established in Switzerland - in the Supreme Court of Appeal (the SCA). This judgement is important and decisive in its declaration that an internet publication in and of itself is insufficient for purposes of conferring jurisdiction on the South African courts, absent other connecting factors. The dispute to be decided: was the High Court correct in holding that it did not have jurisdiction to entertain an application for interim relief, brought by a global health organisation registered in Singapore, relating to online publication of a report on an investigation that took place in relation to a grant project in Pakistan. The outcome: the SCA ruled that the only connection the matter had to the High Court’s jurisdiction was that the appellant’s attorney accessed the report (an internet publication) in South Africa, which is insufficient to establish jurisdiction. NEWSFLASH | In 2021, procedures were created for the registration of #datacontrollers and #dataprocessors established in Kenya. In July 2022, the Office of the Data Protection Commissioner rolled out the requirement to register. Once issued, the registration certificate is valid for two years - meaning entities that were prompt in filing their registration applications following the rollout will now need to consider renewing their registrations. #DataProtection partner, Ariana Issaias, and associate, Vallarie Yiega, urge data controllers and data processors to stay compliant by renewing their data protection registration certificates.
