Beyond "Police Brutality": Racist State Violence and the University of California

From UC Davis to UC Riverside, Global Outrage to Conspiracy of Silence

The events of November 18, 2011, at the University of California, Davis, bear the mark of a certain kind of American racial-political spectacle. An eruption of police violence on that afternoon—what most have named an act of “police brutality”—catalyzed a national and international response, focused on the vulnerable bodies of young white people engaged in an act of civil disobedience. (With due respect to the people of color who were also in the line of fire at Davis, my contention is that their bodies were not the ones with which the national and international response was primarily concerned, nor was their vulnerability centrally responsible for inciting this global outrage in the first place.) The political outcry was primarily fueled by the viral circulation of cell phone, Facebook, and YouTube videos depicting riot-geared police officers dousing the UC Davis Occupiers with caustic yellowish fluid (a widely published still image of which appears here as fig. 1 [editor's note: the above picture]). As this scene becomes momentarily enshrined in the political narratives of the U.S. Left as a reference point for exposing the repressive tendencies of a state (and university system) in crisis, it seems that the spectacle of UC Davis has been isolated from the historical context that has enabled it.

As a point of vital contrast, it is worth remarking that two months after the UC Davis pepper spray incident, on January 19, 2012, a far more massive and militarized display of police force/violence occurred at my home campus of UC Riverside, in which students were actually shot with “less than lethal” police pellets during protests of the UC Regents meeting. In the case of the Riverside campus, UC police were mobilized from every UC campus other than Davis and Merced, and were supplemented by officers from the City of Riverside Police Department and Riverside County Sheriff’s Department. Police helicopters periodically circled over the protest, and officers took what seemed to be sniper positions at strategic high points on campus buildings. The climate was thick with police presence, and the pageantry of political intimidation manifested a massive show of force against the students, faculty, staff, and ordinary people who populated crowd. This police demonstration starkly contrasted with the protest’s well-disciplined adherence to tactics of “nonviolence.” (By way of definition, I do not consider loud chants, intense and vitriolic rhetorics of protest, militant refusal to disperse an alleged “unlawful assembly” or sit-down blockades to constitute “violence”; further, even if one wishes to perform the academic gymnastics of labeling such activities as forms of discursive, symbolic, existential, and/or immanent violence, they are certainly not of a kind remotely comparable to the aforementioned marshaling of legitimated state violence.) For reasons I attempt to explain, we should not be surprised that UC Riverside’s scene of police repression—images of which are also easily accessible via e-mail listservs, YouTube videos, Facebook photos, and the like—has not attracted remotely the kind of attention and righteous reaction as the incident at UC Davis.

Rather than stagnate in the discourse of righteous outrage that is almost reflexively spurred by such events, it may be more useful to pose some hard questions: for example, is it possible that the entwined narratives of moral affront and institutional (university/police) accountability surrounding UC Davis and select other police spectacles—and which may largely exclude police violence in other places—are part of a broader, commonsense conspiracy of silence regarding the where/when/why (and not merely the how) of state violence, and racist state violence, writ large?


Beyond “Police Brutality”

We should be clear: the UC Davis police used caustic “nonlethal” spray on those student protestors because they could. The institutional entitlement to use such police force, however ill-advised it may seem in hindsight, is neither incidental nor ad hoc—it is systemic, legally supported, and absolutely normal. As we pass the twentieth anniversary of the acquittal of five Los Angeles Police Department officers in the street torture of Rodney King, it is urgent to once again examine how police violence shapes our everyday realities in different and contradictory ways.

(A note on the prevailing language: police brutality has become a vastly misused term. While the phrase intends to communicate a sharp criticism of state power that has presumably violated its own self-defined laws and regulations, it is often used to refer to violent police practices that are utterly, ritually sanctioned by law.)

The public response to the display of police violence at UC Davis has been predictably characterized by a combination of righteous outrage and institutional shaming, accompanied by somewhat more muted and unconvincing—though equally predictable—defenses of the UC Davis police department and chancellor. Two facts are not in question: first, the campus deployed an armed police force to squash a conventional act of civil disobedience that was, in the recent historical scheme of things, quite institutionally polite and undisruptive; second, that same armed police force was authorized to use nonlethal weapons on nonviolent student protestors. (We must also remember that the spraying of such chemicals has been widely known to cause death and permanent disability in many instances.)

What does remain in question, however, is how and why these facts are being translated into a liberal-progressive political reaction that seems to naturalize—that takes for granted and/or completely obscures—the fundamentally racial and racist structure of U.S. policing, an apparatus that finds its modern roots in slave patrols, U.S. colonial military outfits (in the Philippines, Puerto Rico, and elsewhere), Texas Rangers (killers of Apaches, Cherokees, and Comanches), and white citizens’ militias throughout the post–Civil War era North and South. In other words, is it possible that much of the critical response to the scene at UC Davis is actually condoning racist police violence rather than challenging it, and if so, what is enabling such critically minded people to do so?

The View from the Other Side of the Barricades [Updated]



From our comrades at Occupy Everything comes this email from UC President Mark Yudof to UCSD Professor Charles Thorpe regarding the police violence at the most recent Regents' meeting at UC Riverside. In the course of the demonstration, police beat protesters with batons and shot them with rubber bullets (for an extended analysis of the day's actions, see this post). Videos like the one above (more here) remind us of what it looks like to face off against a line of riot cops, wildly swinging their batons, cradling and reflexively caressing their firearms, staring out like robots through the foggy visors of their riot helmets. But Yudof's email reminds us of what things look like from the other side of the barricades. Not the cops' view, exactly, though they overlap significantly, but the view of the regents and senior managers themselves. Worth a look.

CUCFA Letter to President Yudof objecting to hiring William Bratton to investigate UC Davis pepper-spray incident

Dear President Yudof,

The Council of University of California Faculty Associations (CUCFA) protests your decision to hire the Kroll Security Group, and its Chairman William Bratton, to conduct what you call an independent investigation of police violence at UC Davis. We take no position here on Mr. Bratton's personal qualifications; our objection is to the conflicts of interest of Kroll Security itself, which is already a major contractor with UC on security matters. According to its website, Kroll's services are not confined to securing databases and facilities from attacks by criminals and terrorists. It also protects many global financial institutions and other multinationals against threats to "operations" that may come from public criticism and direct political action.

By deepening UC's links to Kroll, you would be illustrating the kinds of connection between public higher education and Wall Street that the Occupy UC movement is protesting. Kroll's parent company, Altegrity, provides data-mining, intelligence and on-the-ground security to financial institutions and governments seeking to head off and defeat both private sabotage and public protest. In addition, Altegrity's parent company, Providence Private Equity, is a major global investor in for-profit higher education companies that benefit from the decline of publicly funded higher education.

We already know that Kroll has provided security services to at least three UC campuses for the past several years. This in itself would disqualify Mr. Bratton from participating in the investigation you propose, even if the role of Kroll and its affiliated companies in defending the financial sector against OWS did not raise further questions about its pro-Wall Street and pro-privatization bias.

A truly independent investigation that would allow UC to provide a credible response to the events at Davis (and the other campuses) needs to address several questions that would not be seriously considered if you hire Kroll.

  • What was your role and that of UC General Counsel in the events at Davis? Did you, as a distinguished first amendment scholar, tell chancellors and campus police chiefs that protests (especially protests against UC's own policies) are "part of the DNA of this University" that should not be addressed using the same techniques that UC has developed (likely with the help of Kroll) to deal with terrorists, shooters, and cyber-saboteurs? (Even if you have been a zealous defender of the rising student movement to restore public higher education, such a conclusion would not be credible coming from an investigation tainted by Kroll's conflicts of interest outlined above.)
  • What was and is the role of Kroll in helping banks and public institutions (including UC) investigate and defeat movements such as OWS and their campus counterparts? Is Kroll now acting as a liaison between universities, city governments and the Department of Homeland Security in defending the financial sector against protests occurring on what used to be considered public spaces? Are protests against Wall Street in such spaces now considered a threat to the security of the nation, the city and the public university? (The growing securitization of public space has been a major obstacle to first amendment activity since 9-11.)
  • How much money has UC and its individual campuses paid to Kroll for security services? Were these contracts issued as sole source contracts or was there open bidding? Were Kroll's services confined to protecting, for example, the privacy and integrity of data systems and faculty and staff conducting animal research or did they extended to what Kroll's website calls "organizational threats" arising from "the dynamic and sometimes conflicting needs of the entire campus population?" (This could be a description of the student protests that you rightly regard as "central to our history" as a university.)
  • What led to the issuance of false and misleading statements by University of California officials (Chancellors and their assistants, spokespeople, and police chiefs) in the aftermath of police violence at Berkeley and Davis? Did you encourage these efforts at spin control? (Dishonest statements seriously damage the university as an institution devoted to truth and protect only the individuals whose decisions are in question.)

The broader issue is how protest can be part of what you characterized as "our university's DNA" when the right to protest is not formally recognized within the university's own codes of student and faculty conduct. It could be and should be. The CSU student code states explicitly that "[n]othing in this Code may conflict with Education Code Section 66301 that prohibits disciplinary action against students based on behavior protected by the first amendment." If such language were included in the UC code of conduct, students would have a clear first amendment defense against disciplinary action arising from peaceful political protest-and there would be strong grounds for questioning the legality of a police order to disperse a peaceful protest from a public site on a public university campus. The explicit incorporation of constitutional limits on UC's power to break up demonstrations that threaten its march toward privatization would go a long way toward recovering UC as a public, rather than a private, space. We urge you to see that the UC codes of conduct are amended to parallel those in place at CSU.

Events at Davis and the other campuses have shown the University of California in a negative light, and we agree strongly with the need for an independent investigation. We believe, however, that your appointment of Kroll to investigate the university's response to last week's protest could itself become a basis for new protests, and that you should ask Speaker Perez (or someone unaffiliated with the University) to appoint a genuinely independent committee with representatives from student, faculty, staff and civil liberties groups. Such a committee should be given a specific charge to investigate and report on all of the questions set forth above.

Yudof's Privatization of the UCPD Investigation

In appointing LA Police Chief William Bratton to investigate UCPD police brutality and Berkeley law school's Dean Christopher Edley to "to lead an examination of police policies in handling student protests at all 10 UC campuses" (LA Times), Mark Yudof travesties the independent thought and autonomy that students and faculty are now calling for. Bratton has made his career as an advocate of less physically violent police tactics that control and diminish public space in precisely neoliberal terms. The last thing the UC system needs right now is advice on how to make UCPD even more like a contemporary municipal police force. Similarly, Dean Christopher Edley is one of Yudof's closest companions, best known for his end-run against the expansion of online classes in the face of faculty governance policies. A commission run by Edley is the opposite of an independent commission. Everyone who signed the petitions of outrage against the police violence at Davis and Berkeley ought to mobilize against this. (I hope the owners of the petitions can use any emails attached to the petition process to re-contact literally everybody.)

There is one thing that is good about Yudof's move: it makes in the most public of circumstances the same move that he has made throughout his career as a privatizer of public goods. Yudof has done to the UC at every level and in detail the same thing he is doing now: passing off as reform what is actually vulgar cronyism on behalf of the 1%. Now this will be visible to everybody, even far outside the UC -- if we make it so.

The time has come to voice our rage at the ongoing attack on public education in California and across the globe. This past July the UC regents raised tuition by almost 10%, bringing the total tuition increase for the fall to 17.6%.

President Yudof and the regents will be meeting November 15th to discuss still more austerity measures for years to come. We need to let them know that there will be consequences for the actions they choose to take.

It's time for students at UC Davis and across the state to stand united against such belligerent acts and to send a clear message to the administration that we will not sit idly by as they devastate the future of our communities.

So Much for Solidarity

At times, the UC faculty has been something of a fickle ally in our fight against austerity and privatization. The massive walkout on September 24, 2009 was successful precisely because the faculty had invested large amounts of time and energy in organizing over the summer, but as the protests began to escalate in the fall they became hesitant and many withdrew. Many students outside of Wheeler Hall on November 20, 2009 were shocked to see the faculty they saw as the most radical and sympathetic yelling at them to sit down and back off, that the squads of heavily-armed riot cops were there to protect them. After the incident at the Chancellor's house, perhaps, the split became insurmountable. A sign of this rupture is the infamous email where Professor Wendy Brown calls the Live Week protesters "hooligans" and "10 year olds," and the protest itself "pure stupidity" and "bullshit." By the spring, most of the faculty (with a few singular exceptions, of course) saw themselves as fully external to the anti-austerity struggle at the university.

Seen in this light, it's not particularly surprising that the UC Academic Council, the administrative arm of the Academic Senate, has come out in favor of tuition increases [PDF]. While "register[ing] dismay at State's continuing disinvestment in higher education," the resolution concludes:
The Academic Council advises President Yudof to request that the Regents increase mandatory systemwide charges effective in Fall term 2011 in an amount sufficient to offset the $150 million reduction in State funding contained in the State 2010-2011 budget.
If solidarity is about drawing lines that separate friends from enemies, then this statement is incredibly revealing about not only where we should situate the faculty but also how the faculty see themselves. As laripley says, "so much for solidarity."

[Update Saturday 12:44pm]: Via dettman, the Academic Council is also apparently in favor of expanding contingent labor:
As reported in the SF Chronicle, the Academic Council recommended last week that the University expand the use of contingent faculty "where appropriate" across the system, in the words of system-wide senate chair Dan Simmons. We have not seen any official announcement, or document such as meeting minutes to confirm this. But this would appear a major shift in the official position of the faculty: since when does the Senate recommend the expansion of non-senate faculty? It's enough that the administration has become addicted to the use of exploited, under-paid, and over-worked lecturers. It's a completely different position for the system-wide senate to come to the same conclusion. The senate should be in the business of expanding (at least some of) the benefits of the tenure system to contingent faculty -- not sell our collective soul to satisfy the administration's appetite for a flexible workforce.

Brown's Austerity Budget and the UC [Updated]

[Updated Wednesday 6/29 10:03am]: The LA Times headline says it all: "Democrats Pass Austerity Budget for California": "The Legislature passed an austerity budget Tuesday night that would cut from universities, courts and the poor, shutter 70 parks and threaten schools but would not -- by officials' own admission -- restore California's long-term financial health." As for public higher ed, the Chronicle reports that tuition hikes at the UC and CSU are a "certainty." Also check out the graphic above: "Trigger Cuts, Chopping Blocks."

Two weeks ago, we wrote about the austerity budget that was coming through the California state government. It all turned on Governor Brown's call for a special election in mid-September in which voters would decide whether to approve five-year tax extensions as an additional source of revenue to ride out the financial crisis. Today that proposal has been scrapped:
Gov. Jerry Brown relinquished a cornerstone of his budget plan Monday by forfeiting a 2011 tax election and securing a deal with Democratic lawmakers that shortens the school year if tax revenues fall short of optimistic projections.

After months of seeking GOP votes, Brown decided four days before the new fiscal year that a bipartisan deal was impossible. The Democratic governor wanted Republicans to pass a temporary extension of higher sales and vehicle taxes as a "bridge" to a fall election, but Senate Republicans would not vote for taxes.

"I thought we were getting close, but as I look back on it, there is an almost religious reluctance to ever deal with the state budget in a way that requires new revenues," Brown said, sitting at the end of a wooden bench in his office with Senate President Pro Tem Darrell Steinberg and Assembly Speaker John A. Pérez.
In that earlier budget plan, Democrats in the California legislature proposed an additional $150 million in cuts to both the UC and CSU systems (that is, $300 million total), on top of the $500 million (again to each) that's already been cut. Brown vetoed that budget, but it's now clear that it wasn't out of a desire to protect public education:
Under the new plan, the University of California and California State University will each absorb additional $150 million reductions, for a total of $650 million apiece. They risk losing another $100 million each if the state falls short of revenues. The university systems already have said they will seek tuition hikes to offset new state reductions.
And it's likely to get even worse:
Based on additional revenues that have come to the state so far this year, the budget assumes a very optimistic revenue scenario for the rest of the year. But if the revenue estimates prove unrealistic then there are triggers for additional cuts. These include an additional $100 Million in cuts for both UC and CSU, the possibility of further cuts to K-12 and a further shortening of the school year [by seven days].
Yesterday, the Daily Bruin published an interview with outgoing chair of the UC regents Russell Gould, in which some pretty decent questions are posed (though there's not a whole lot of follow-up). One of the issues that came up was the recent budget passed by the Democratic legislature (on which today's deal is based). Why, the paper quite reasonably asked, should we believe in the UC administration's commitment to fighting for public education, let alone their strategy for winning that fight, especially when even the Democrats have apparently sold us out? Gould's pathetic answer:
Regrettably I think that Sacramento is listening to lots of voices. We’re among them, and I think we’ve got a stronger effort than we’ve ever had to push legislature and governor to push UC, but we’re fighting a lot of other interest groups that say, ‘We’re more important.’

Yet when I talk to legislators and talk to people in the governor’s office, they seem to understand the link toward building businesses, building opportunity and having (a) kind of society and economy that’s sustainable. But when it comes to the short-term decision they seem to put their resources in other places. And that’s what we’re continuing to fight.
And, right on time, UC president Mark Yudof comes out with a statement on his Facebook page outlining how the UC administration would "continue to fight," as Gould put it: by "fully supporting" Brown's attempt to balance the budget.
I fully support Gov. Brown's plan to bring the state budget into balance. This includes his call for an extension of certain temporary taxes that he believes is needed to act as a bridge until the plan can be placed before California voters.

In my view, what the governor has proposed offers the surest pathway available to a more stable fiscal future for all of California, including its public universities. Reliable state support is crucial to the continued excellence of the University of California and the students and families it serves.

The Strategic Value of Summer


Summer means no students -- for the UC administration, that means the absence of one of the largest obstacles to their privatizing designs. There's a similar logic in the UC regents' decision to hold their meetings at UCSF Mission Bay. It is a highly strategic space: not only is it extremely out of the way and difficult to get to from Berkeley, but it's also located in what is essentially a post-industrial wasteland, with little else around to provide cover. After thousands protested the meeting at UCLA in November 2009 to approve the original 32 percent tuition hike, it seems the regents decided to retire to less accessible locations.

Summer vacation is the temporal version of UCSF Mission Bay. It's not surprising that it was in July 2009 that the regents voted to give UC president Mark Yudof "emergency powers" due to the "state of financial emergency," which gave the administration unilateral authority to impose austerity measures. Especially as "shared governance" becomes less and less of a reality, we should expect more and more executive decisions to be made and policies to be approved at this time of the year.

The title of this article in the Santa Cruz Sentinel is right on: "During Serenity of Summer, UCSC Implements 'Painful' Cuts."
SANTA CRUZ -- UC Santa Cruz's wooded campus is relatively serene in the early days of the more quiet summer session.

Beneath the tranquility though, the campus is set to execute another round of cuts including laying off roughly 50 non-academic employees in what has become an annual occurrence since 2008.
The layoffs go into effect on Friday, July 1, the start of the new fiscal year. In addition to layoffs, workers are seeing their hours (and pay) cut back. As expected, these cuts will primarily affect non-academic workers. (While there are no layoffs on the academic side of things, 40 more faculty positions that are currently empty, and 120 teaching assistantships for graduate students, will be permanently eliminated.) While UC spokespeople talk about how much much their work is valued, they acknowledge that the student-as-consumer is the primary target.
"After years of reductions in state support, we've gotten to the point where every corner of the campus has been impacted by these cuts," UCSC spokesman Jim Burns said. "It's also true that units farther from the classroom have been particularly hard hit -- not because the campus doesn't value those areas and the people working in them. But because we have tried to the extent possible to reduce cuts to the academic areas in an effort to protect student access to the courses they need."
Much like the tuition increases, however, these poverty wages are not a function of the so-called financial crisis. Rather, it's a function of a class war that's been occurring for decades:
During her two decades at UCSC, [custodian Rosario] Cortez has held several second jobs, including other custodial positions and a job at a bread factory. Currently she works five days a week at UCSC, eight hours a day, where she earns about $2,200 a month after taxes, then makes and sells tamales on the weekends for extra income.

Cortez's sentiments were echoed by Ernesto Encinas, a cook at UCSC who cares for his 86-year-old mother and 14-year-old son.

"Everyone I know has a second job," Encinas said. "There is no rest with the wages we make here. You can't make ends meet with just the one job with the way cost of living keeps rising. Any little change in our income can be devastating."
With these cuts comes not a decrease in the amount of work expected but precisely the opposite: speedup. Custodians, for example, are required to clean more areas during a single shift. Administrators get around this in a curious way -- by telling workers, apparently, to "clean less," that is, to do a worse job at cleaning more areas. It's a recipe for disaster -- especially in the context of ongoing layoffs, this amounts to an incredibly difficult balancing act for the workers. On this note, check out what an asshole Jim Dunne, the director of UCSC's physical plants department, is:
"I have heard [the complaints]," Dunne said. "We often only have a few months to implement changes and rework how we do things. We are making a lot of effort to communicate to custodians what that redesign is, but adjustment takes time. It is a difficult situation for both sides. Custodians take a lot of pride in their work. When you tell them to clean something less, that's hard for them."
Yeah, that's the only thing that's hard for them.

If they ever doubted it before, UC administrators now understand that the best time to implement austerity are the summer months. Summer evacuates much of the potential resistance -- with students and faculty mostly away, the only thing standing in the way are the workers, precisely those hardest hit by the cutbacks. It also functions usefully as a time barrier -- one of the administration's most effective tactics is simply to wait protesters out. (Look at what's happened with the last two hunger strikes at UC Berkeley.) Finally, summer marks the point at which many veteran student protesters graduate and move on. For anti-austerity protesters, it will become increasingly important to incorporate the summer into strategic thinking. This does not necessarily imply a need for stable organizing structures, which contribute their own problems, but it does indicate the need to directly address and even intervene in some way during these months. After all, the success of the walkout on September 24, 2009 depended on the work that was done by students, faculty, and workers before the school year had even begun. This does not necessarily have to take place on campus. It could also mean looking to other organizing bodies outside the spaces of the university that are attempting to build capacity for resistance against austerity.

If fall is the moment of attack, and after the fall the moment of reflection, then before the fall is clearly the moment of preparation. But maybe it's time to rethink this calendar?

Excellence, Access, Affordability

The other day we posted on the legislative operations that have produced a series of austerity budgets for the state of California. Of course, the services that are on the chopping block are both significant and diverse -- the cuts will affect far more than public education. But for obvious reasons public higher education is usually our point of departure. Anyway, in that post we looked at the responses of the UC administration to the Democrats' proposed budget plan, which would have included another $300 million in cuts to the UC and CSU systems (if it hadn't been vetoed by Governor Brown). First came the statement of UC spokesperson Steve Montiel, which noted that "Any further cuts would threaten our ability to provide access, affordability and academic excellence." Then we turned to a statement signed by UC president Mark Yudof and UC regent chair Russell Gould, which asserts that "An additional $150 million in cuts will impair our ability to provide access at an affordable price while preserving academic excellence."

Access, affordability, and excellence. These qualities -- which, it's worth mentioning, are defined only in broad, meaningless strokes -- are what Yudof has called the UC's three "compass points." Here's how Yudof referred to them at the UC regents' meeting in January 2011 (this quote is under pretty heavy rotation these days):
Yudof said the university has long operated on three "compass points" -- access, affordability and excellence.

"We are moving dangerously close to having to say: pick two of the three. That’s my view, and the excellence is nonnegotiable," he said. "We are going to have to look at access and affordability."
Yesterday, the day after the statements from Montiel, Yudof, and Gould were printed, Chancellor Robert Birgeneau published his own statement, which was emailed to the entire UC Berkeley campus and is posted here. He writes:
As you know, Berkeley already faces extraordinary challenges for the coming year. Our share of the $500 million cut from the Governor’s proposed budget is about $70 million. On top of the proposed cuts, the campus has additional mandatory increased costs such as utilities and health care benefits for which we must find $40 million. Thus, in effect, we are already facing $110 million in cuts for 2011-12 and we cannot sustain any further cuts without placing an intolerable burden on our students and staff. Specifically, the legislature’s budget would have added as much as $25 million to this shortfall, an amount which we simply cannot bear. Not only would this be very painful for our campus, it would ultimately be damaging to the economy and future prospects of California.
As usual, the official response takes a specific form: it once again turns on the logic of the words further/additional. This formulation erases everything that has already happened, removes it entirely from the political horizon. As we wrote here last month,
In addition to erasing the violence of austerity . . ., this strategy charts a path of rhetorical retreat. Obviously this isn't a rousing defense of public education. But it leads to another danger: every time the budget is cut, it's a "disaster"... until the cuts go through. At that point it becomes the new normal. In effect, it represents an attempt to limit political struggle to a relatively minor question about what's currently on the table -- everything else simply disappears.
That's bad enough. But, to return to Yudof's "compass points," something unexpected goes wrong in the next paragraph of Birgeneau's statement:
I know that the Cal community cares deeply about public higher education and understands the importance to the state and to the nation of the education, research and public service that we provide. I want to assure you that we will not compromise on our principles of Access and Excellence. I urge you to join me in telling your local legislators, leaders in the Assembly and Senate, and Governor Brown himself that they must arrive at a budget agreement that does not require further cuts to the University of California.
Either Birgeneau didn't get the message (shhhhhh!) or the decision that Yudof was alluding to back in January has already been made. Not that we were under any illusions about the UC administration's commitment to "affordability." Tuition has skyrocketed, up 40 percent in the last two years and 300 percent in the last ten.

When even the rhetorical flourishes have disappeared, nothing will hold back the coming wave of tuition increases -- or stop the plodding advance toward privatization.

A Brief Primer on the Austerity Budget



We generally rely on other folks to analyze the budget at the state level, especially as it relates to public education but more generally in the current context of austerity. Instead we usually prefer to focus our attention on the UC administration and the UC regents. But so far we haven't found anything that lays out the process and timeline for the austerity measures that are going to be imposed on the UC in the near future. That's what we want to do here.

First of all, there are a couple of upcoming dates that are important. Today, June 15, marks the deadline by which the state legislature has to pass a budget. If they don't pass one by midnight, their salaries will be permanently docked, as stipulated by a new ballot measure that was approved here last November. Without getting into the boring and mostly irrelevant details of the party politics involved in these decisions, the bottom line is that the Democrats have finally produced a budget proposal, one that they can pass without any Republican votes. Included in the proposal are another series of cuts -- surprise surprise! -- including a additional $300 million of cuts to the UC and CSU systems ($150 million to each), on top of the $500 million already cut, as well as the deferment of $540 million already owed to the UC and $750 million from canceling "old school debts" (money owed to public schools?). As thosewhouseit noted this morning, these cuts will devastate K-12 and higher education in California -- both of which, as we well know, have already been decimated by massive cuts.

So, as expected, this is a shitty deal. It's austerity, plain and simple. It's not necessarily going to pass, since Governor Brown could theoretically veto it [Update Thursday 11:13 am: Brown has officially vetoed the budget plan], but what's important is the generalized agreement by pretty much all of the political elites involved in the decision-making process, regardless of their party of affiliation. In broad strokes, they are all in agreement as to what the problems are and as a consequence the solutions as well. Take a look, for example, at Brown's recent video statement on the budget.



What Brown presents in the video -- and remember, of course, the Brown is a Democrat -- is a series of austerity measures. He calls explicitly for "deep and permanent cuts to ongoing state programs" and what he labels "reforms," which refers above all to the reformulation of public sector pensions and, as he puts it, "a cap on ongoing state spending." Furthermore, the taxes that Brown is calling for are temporary.

Which brings us to the next set of important dates. July 1 is the beginning of the new fiscal year, which means (for our purposes here) that the state sales tax will decline by 1 percent and the vehicle registration tax by 1/2 percent. Governor Brown's tax proposal, then, has two parts: first, it postpones the expiration date of these taxes until mid-September; at which point, second, a special election will take place in which California voters will vote on whether or not to extend these same taxes for another five years. At worst, then, the vote will fail, and the taxes will not be extended -- this seems like the most likely outcome at this point. But what's most depressing about the whole thing is the fact that the taxes are at best temporary. In other words, the entire premise of Brown's proposal is that services provided by the state must be eliminated -- the only question is how fast the transition will be. It's not that we didn't know this already, of course. From the beginning, Brown's politics have been characterized by a commitment to austerity.

In some sense, the special election in September will have large consequences for California public education. If it fails, UC spokespeople have stated, tuition will be jacked up by another 32 percent at the beginning of the winter 2012 semester. (And remember, that's on top of the 8 percent hike that's already been programmed for fall 2011.) This would bring in-state tuition in the UC system to $15,000 a year. But at the same time, the UC administration has already made the choices that have condemned the entire UC system to privatization. The regents are incapable of making a case for public education not because they're bad speakers or because they've misunderstood the subtle details of the university system but because they don't give a shit about public education. As in the case of the $500 million already cut from the UC in the first round of budgeting, every defeat becomes the point of departure for the next one. More than just a losing strategy, we could easily read this as purposeful -- it allows the administration to continually deflect blame while moving the university toward a privatized model.

Right on cue, the UC once again trots out the same old arguments. Here's what UC spokesperson Steve Montiel told the Sacramento Bee about the Democrats' new budget, which includes the $150 million cuts mentioned above:
"We are assessing the latest proposal from the state Senate, and it's too soon to say with certainty what the impact would be. But there's no question that additional cuts would not be good news for UC and the Californians it serves. The university already has taken steps to absorb a $500 million cut, and we have been preparing contingencies in the event of an all-cuts budget. Any further cuts would threaten our ability to provide access, affordability and academic excellence."
And now, UC president Mark Yudof and UC regent chairman Russell Gould have released the following statement:
UC, like the California State University, already has taken steps to absorb a $500 million cut with substantial impacts to programs on the campuses. An additional $150 million in cuts will impair our ability to provide access at an affordable price while preserving academic excellence and allowing students to complete their degrees in a timely way. If this budget plan stands, the likely result will be a double-digit tuition increase on top of the 8 percent hike already approved for next year.
It's the usual trope -- both formulations turn on words like further and additional. What's especially revealing here is the way that Montiel, Yudof, and Gould frame the consequences of these further/additional cuts. Because the talking point of the managerial trinity of "access, affordability, and academic excellence" on the proverbial chopping block has been active since early January at the very latest, when Yudof laid out the changing relationship toward what he called the UC's three "compass points":
Yudof said the university has long operated on three "compass points" -- access, affordability and excellence.

"We are moving dangerously close to having to say: pick two of the three. That’s my view, and the excellence is nonnegotiable," he said. "We are going to have to look at access and affordability."
To return to the statement by Yudof and Gould for a second, take a look at the sentences that come right after the above quote:
And to require UC to carry a $500 million "loan" balance into fiscal year 2012-13 because the state can't provide UC with the fully budgeted allocation will only force the university to incur extra costs that are passed on to students and their parents. In addition, this budget plan poses a threat to UC and higher education in future years as it fails to achieve a sustainable, balanced budget. Without a stable, predictable funding base, our long-term quality is seriously threatened.
It's worth noting that the regents haven't had any problem with passing on "extra costs" to students and parents in the past. That's why tuition has increased 40 percent in the past two years, and 300 percent over the past decade. But what's especially interesting here is the tension between the seemingly out of place call for a balanced budget and a "stable, predictable funding base." After all, the requirement of a balanced budget is precisely the reason that these new cuts have been proposed -- according to the new ballot proposal, the Democrats in the legislature must pass a balanced budget or face a pay cut. So what they've done is cut us instead.

In the end, the "stable, predictable funding base" called for by our corporate overseers gives us the key to unraveling their odd statement. They know, as we do, that the state will never provide the kind of financial stability or predictability they seek. Yudof has long called the state an "unreliable partner" and he has been given no reason to think differently. What this statement does is begin to lay the groundwork for a full shift toward the corporate university -- the "stable, predictable funding base" that the state cannot supply will be sought elsewhere. And we all know where that elsewhere is.

Whose University? On Yudof and "Us"



On May 17, UC President Mark Yudof delivered the keynote address at the annual meeting of the American Law Institute (ALI) in San Francisco (via). His talk, titled "Whose University? The Decline of the Commonwealth and Its Meaning for Higher Education," is available both in text form as well as in the video above. Those of us willing to subject ourselves to the torture of watching the full speech in the video, however, will discover that what Yudof actually said diverged in some fairly significant ways from the original script. What we want to do here is think through and analyze Yudof's invocation and mobilization of this highly specific language of protest, on which, as the title of the talk suggests, his entire argument turns.

Consider the following passage, which sets up the rest of the talk. We've edited the passage based on the video, striking out the words that were not said and adding in italics those that were inserted. It begins at about 11:05 in the video:
Now, during the many demonstrations against fee increases, students and their allies have consistently taken up the chant: "Whose university? Our University!" In my day, and admittedly when the dinosaurs roamed the earth, the battle cry was "make love, not war," a call to arms which I personally find more alluring. [Laughter]

But I do get the point the current students are trying to make -- that is, that they have a stake in the administration's decisions administration, they have a stake in the university, they have a stake in the decisions the legislature, the board of regents, and others make.

Still, the more I ruminate over the question "Whose university," the more I realize that this chant actually frames a more profound societal question, one with implications far beyond the University of California, or even public education in general.

It's a question for American society as a whole -- how to distinguish between the "public good" versus the "private good," and how to strike a balance between the two. A balance that navigates at least in my judgment a course between JFK's noble call and the rhetorical stance of some politicians that government is never the solution, only the problem.
Apart from his stale jokes, there are a couple things to notice here in the way Yudof frames the meaning of the rhetorical question and answer "Whose university? Our university!" As in the case of the protesters who chant these words, the question for Yudof is a rhetorical one -- the speaker already knows what the answer is. Tensions emerge at the seams, that is, over the path of the lines that we, with these words, attempt to trace between friends and enemies. What is at stake, in other words, is the meaning of the word "our" and, by extension, of its opposite, "them." Solidarity is how we define friends and enemies.

With this in mind, take a look at the gap between the prepared speech and the actual remarks. Yudof invokes the slogan, and goes on to claim that he understands where the students are coming from: "I do get the point the current students are trying to make." What they want is to have a stake in -- and here the speech diverges from the text -- not the "administration's decisions" but the decisions of the administration, the university, the legislature, the board of regents, and so on. In moving away from the prepared text, Yudof expands the political horizon of the students' supposed demands. How do we read this expansion? A generous reading might suppose that Yudof is acknowledging the call, for example, to "democratize the regents," that is, situating the protests within a broad political context and recognizing just how far-reaching these demands can be. (But we know what Yudof actually thinks about democratizing the regents: "I don't like it much personally speaking.")



Notably, one of the institutions that students supposedly want to have a stake in is not like the others: the administration, the university, and the board of regents constitute the governing apparatus of the UC, but to invoke the legislature is to shift the domain of struggle away from the space of the university. While seemingly expanding the political horizon of possibility, this move at the same time attempts to close the door on a set of tactics and strategies that have proven useful to students, workers, and faculty who see the UC administration as a necessary target in the struggle over public education and against austerity.

It is this move, furthermore, that enables the rest of Yudof's speech. The co-optation of the protest slogan allows him to push "far beyond the University of California, or even public education in general" to "American society as a whole." What he's driving at, in other words, is a more general question of political economy that focuses on the relationship between public and private goods. For Yudof, this argument serves a useful purpose because it situates politics firmly within the realm of the state and within the strategy of the vote. Politics is thus reduced to little more than a question of persuasion, of campaigning, of donations -- similarly, it is isolated within the relatively homogeneous field of political parties, all of which, it turns out, are down with austerity.

Yudof has other reasons for abstracting the conflict to an oversimplified discussion of public and private goods -- because his proposal is to sketch out a "balanced" approach or middle ground. This "hybrid university," as he calls it, occupies an uncomfortable position between the two poles. Uncomfortable because of its instability, oscillating from private to public and back again throughout the talk. But these are rhetorical hues -- the hybrid university that Yudof outlines ends up resembling a corporation more than anything else. He declares, for example, that universities must "look at their operations with a 'private' sensibility. They should establish realistic priorities, eliminate weak programs, adopt money-saving IT services, and aggressively reduce waste." Not only must it adopt corporate practices, but it must also be seen and imagined through a corporate, economistic lens:
[T]he university maintains a critical role in this state's wealth creation. Because if the pie doesn't grow, it's difficult to realize the ambition of bridging the divide between our private and public sectors.

So, in order to preserve these missions, public universities must be able to depend on a three-part funding base -- one of student-family contribution, private support and state funding.
The equilibrium of the "hybrid university," balanced between private and public funding, is undone: the "three-part funding base" has overturned the dual foundations that Yudof originally seemed to propose. It is now two parts private (the student-family debt burden along with corporate investment) to one part public (state funding). As Bob Meister has observed, however, the UC administration has a vested interest in shifting away from state funding, which comes with certain restrictions regarding how it can be used:
[A]lthough tuition can be used for the same purposes as state educational funds, it can also be used for other purposes including construction, the collateral for construction bonds, and paying interest on those bonds. None of the latter uses is permissible for state funds, so the gradual substitution of tuition for state funds gives UC a growing opportunity to break free of the state in its capital funding.
In attempting to shift the location of "Our university!" to the broad terrain of democracy and the "American public in general," Yudof constructs a unified "we" that seeks to conjoin the administration with the protesters, blurring and diffusing the tensions between these structurally opposed positions. Against this "we," presumably, stands the "them" of the state. But we know that those who run the UC are the state: Yudof himself was appointed by the Board of Regents, each of whom was directly appointed by the governor, commonly in return for political favors. Sacramento is everywhere. Yudof's "we" thus serves to confuse and disrupt our lines of solidarity. In the end, it is the UC administration that is to be held responsible for the tuition increases, for the layoffs, for programs eliminated, at the same time as they increase their own ranks and salaries. They are austerity; they are our enemies.

Austerity, of course, is implemented at the barrel of a gun. Behind every fee increase stands a line of riot cops. It goes without saying that Yudof is well aware of this. Returning to his speech at ALI, we find the following paragraph early in his prepared remarks:
I've been forced to preside over the furlough of employees, myself included, and a 40 percent increase in tuition. I've faced a variety of demonstrations -- a rich cornucopia of folks exercising their free speech rights. It's certainly given me a new perspective on my First Amendment course.
But what he actually says is this (starting at 9:10):
I've been forced to do some things which I daresay have not been popular with the faculty, the staff, and the students. I've presided over furloughs of virtually all of our employees, including me -- that really hurt, they celebrated my furlough days at the office; a 40 percent increase in tuition in three years; and I've found . . . that I always had an enthusiasm for the First Amendment. I taught a course on it, Constitutional Law. What can I say: California is a rich cornucopia of folks exercising their free speech rights. [Laughter] It's certainly given me a certain perspective on the Constitution: if I ever go back to law teaching, which I expect, I'm going to start with the Second Amendment, that's my plan. [Laughter] And I may deal with quartering of soldiers, I don't know, Letters of Marque and Reprisal, there are all sorts of things I could deal with. [Laughter]
This is lawyerly humor of the pathological variety -- it's no wonder the lawyers in the audience crack up. Yudof's response to the protests is not, as he suggests in the earlier passage, to "ruminate" on the students' demands, but to rhetorically draw his gun and quarter his soldiers (UCPD) on university grounds. This is the kind of leadership that ends in Jared Kemper pulling his gun on unarmed students at the UC Regents' meeting in November 2010; and police surveillance and infiltration of student groups across the UC system.


And those Letters of Marque and Reprisal?
In the days of fighting sail, a Letter of Marque and Reprisal was a government license authorizing a private vessel to attack and capture enemy vessels, and bring them before admiralty courts for condemnation and sale.
What we have here, in other words, is a declaration of war. But this war takes a very specific form: the state-sponsored and -authorized expropriation and privatization of enemy (in this case public) goods. In this little bit of improvisation, Yudof reveals, if not the administration's strategy of counterinsurgency, then certainly the violent logic of austerity in its clearest form. Behind heavily-armed and militarized agents vested with the full juridical authority of the state, austerity advances slowly but steadily.

What we mean when we shout "Whose university? Our university!" has little to do with the legislature or the American public in general. It has to do, as one might expect, with the university. It is our demand that those work at and use the university, those who make it run, those who schedule, teach, and take the classes, those who advise and provide support, those who maintain its spaces -- in short, everything but the bloated administration -- are the ones who should run the university. "We" face off against "them"; they are the management, the administrators. In the end, they will be abolished, as we have no need for their dismal cutbacks, their prefabricated capital projects, their rules of conduct, or their police. They are useless to us.

Meet Sherry Lansing, the New Chair of the UC Regents

At the most recent UC Regents' meeting, which took place over the past two days, Sherry Lansing was elected to be the new chair of the board, replacing outgoing and two-time chair Russell Gould. So who is Sherry Lansing? The Daily Cal reports:
Prior to her appointment to the board, Lansing was a high school math and science teacher in Los Angeles.
Aw, that's so sweet. She's really just like one of us. She's truly the "middle-class" regent we've been looking for to protect us from these budget cuts!
She also ran her own production company and most recently was the chairman and CEO of Paramount Pictures.
... oh. Well, okay, she was the CEO, but movies are fun though, right? Everybody loves movies. She was involved in the production of Forrest Gump! Maybe she's not one of these corporate assholes who make up the rest of the board. Why don't we check in with our good friend and investigative reporter Peter Byrne, to see what he has to say about Regent Lansing:
Since September 2006, Regent Lansing (who is not on the investment committee) has been a member of the board of directors of Qualcomm Inc., for which she receives an annual director’s fee of $135,000, plus stock options. According to her economic disclosure statement, Ms. Lansing owns “more than $1 million” in Qualcomm stock options (no upper limit is specified). In 2009, Qualcomm paid her $485,252. Documents released by the UC Treasurer show that, after Ms. Lansing joined the Qualcomm board, UC quadrupled its investment in Qualcomm to $397 million. Ms. Lansing told us that she did not instruct the treasurer or members of the investment committee to buy Qualcomm stock.
Hmmmm. Okay, well, at least we should give Lansing a chance to explain herself and her positions to us, you know, in her own words:
"I'm honored to serve as chairman during these difficult economic times," Lansing said in a statement. "To meet our challenges, we have to look for cost savings as well as other sources of revenue. But as we face these financial struggles, one thing we will never, ever sacrifice is the quality of a UC education."
Two quick thoughts on the commitment to "never, ever sacrifice . . . the quality of a UC education." First, online education. Nuf said. Second, we keep coming back to this quote from Mark Yudof (not only UC President but also himself a member of the board of regents), which does a nice job of contextualizing what this talk about "quality" really refers to. In a statement after the January Regents' meeting, Yudof made the following comment:
Yudof said the university has long operated on three "compass points" -- access, affordability and excellence.

"We are moving dangerously close to having to say: pick two of the three. That’s my view, and the excellence is nonnegotiable," he said. "We are going to have to look at access and affordability."
If "quality" and "excellence" are as commensurable as they sound, then Lansing's statement suggests that Yudof's "compass points" continue to shrink: the plan is no longer to pick two of the three, but to focus on one.

And these tuition hikes could be implemented as of winter 2012:
SAN FRANCISCO -- University of California tuition could soar next year if Gov. Jerry Brown's state budget plan doesn't pan out.

School administrators told the UC Board of Regents Wednesday the university would likely have to raise tuition 32 percent for the winter 2012 [on top of the 8 percent already programmed for fall 2011] term if the state doesn't extend temporary tax increases as Brown proposes.

Under that scenario, California residents would pay nearly $15,000 in tuition to attend one of UC's nine undergraduate campuses.

The governor has already signed legislation reducing support for UC by $500 million to roughly $2.5 billion for the coming fiscal year.

When Brown issued his revised budget proposal Monday, he warned that UC could lose another $500 million if the state does not extend the taxes. So far he doesn't have enough Republican support for his plan.

UC Regents Meeting, May 17-18


Today and tomorrow the UC Regents are meeting once again at UCSF Mission Bay, certainly the most out-of-the-way and at the same time one of the most heavily policed of all the UC campuses, to discuss cuts in funding from the state in light of the May revision of Governor Brown's original budget proposal, which was released yesterday. While the budget revision is largely being touted in the media as good news due to the fact that revenues have so far been unexpectedly high, a closer look reveals that the crisis remains basically unchanged. $500 million worth of cuts for the UC system, and another $500 million for the CSU system, have already passed the California legislature, and will not be recovered. Furthermore, the budget revision continues to rely on the successful passage of several tax extensions -- an outcome that is far from guaranteed and indeed looks increasingly unlikely.


UC President Mark Yudof released a statement yesterday on the budget revision. In it, he once again stakes out a position not against budget cuts but against more budget cuts:
Today, in issuing a May revision of his budget proposal, the governor also described reductions that would be proposed should the state adopt an "all-cuts" budget in lieu of extending certain temporary taxes.

The governor in his budget document asserted that, in an all-cuts budget, reductions in state funding for the University of California would be doubled, to $1 billion in cuts.

A cut of this magnitude would be unconscionable -- to the university, its students and families, and to the state that it has served for nearly a century and a half.

Doubling the cut would reduce the state's contribution to the university's core funds -- monies that pay professors and staff members, light the libraries, maintain the campuses, and all the rest -- to roughly $2 billion. State funding of UC at this diminished level has not been seen since the early 1990s, a time when the university enrolled 80,000 fewer students.
Yudof's entire argument is based on the premise that the first $500 million is no big deal. It's gone, disappeared, vanished, erased, like it never happened. Let bygones be bygones. What matters, in other words, is not the cut but only the possibility of "doubling the cut." One way of reading this argument is that Yudof is being proactive -- he's getting out there ahead of the curve, to denounce budget cuts before they happen. To a certain extent, that's true. But the problem is that once the budget cuts actually happen -- and they always happen, sooner or later -- they are automatically taken off the table in the name of "being pragmatic." The new budget, with $500 million less, becomes the new baseline against which all future arguments about the budget are framed. Clearly, this is not the way to defend public education. On the other hand, it's a great way to continue to push tuition increases on the public, transferring the burden of debt from the university to the individual student and enabling the university to sell highly rated construction bonds for further infrastructure development.

Yudof goes on to declare that "What this reduction most likely would mean . . . is the need to yet again raise tuition." This statement ignores the fact, to begin with, that an 8 percent tuition increase is already programmed for next fall. Yudof loves to gloss over that increase. In an interview back in March, for example, he asserted that "I’m not planning on recommending a fee hike beyond what is already on the books, which is 8 percent in September." The structure of his claim mirrors that of the statement on the budget revision -- once something happens, it's like it never happened.

The corrupt, unaccountable, millionaire UC Regents aren't going to make any decisions at this meeting. But they've made clear that, in addition to the 8 percent fee hike that will go into effect however much they try to talk around it, they're liable to raise tuition by another 32 percent if the tax extensions in the new budget aren't approved. In that situation, furthermore, the CSU trustees will raise tuition by another 32 percent over and above the 10 percent increase they've already programmed in for the fall. 32 percent, it seems, is the magic number.

The Culture of Helplessness at the Top

The supposed impossibility of that version of California is not a fact of nature. It has been and is continually created by the decisions the major players make on a daily basis. This includes UC’s Regents and Office of the President. In these cases, their agency is regularly concealed behind a consistent strategy of blame-shifting onto the state legislature and, behind them, the voting public and their alleged universal rejection of the very concept of a public good. The university's decline has been accelerated by a culture of helplessness at the top, one which assigns blame elsewhere and helps to demobilize its own community.

The Ides of May

Governor Brown will release his revised budget on Monday the 16th, just after the Ides of May (May is one of those months -- including March -- when the Ides fall on the 15th as opposed to the 13th). That is when we'll know if the University will bear the full brunt of the "all-cuts" budget, i.e., $1 billion, or whether it will be cut "only" $500 million.  It's a sad testimony to the state of UC that we are all sitting here hoping for a $500 million cut.

Some have surmised that the Governor is pursuing a "reverse Norquist." The Norquist doctrine contemplates implementing popular tax cuts in order to shrink the government, to the point where you can "drown it in the bathtub." A reverse Norquist, supposedly, pursues ruthless cuts to build up support for necessary tax collection. Both doctrines are, of course, flawed. The Norquist doctrine ignores that big corporations and the financial oligarchy have way too much to gain from their control of our supposedly democratic government to actually want to drown in the bathtub. It will never happen. Government might well get meaner towards the poor and the middle class, but it's way too useful to the oligarchy to disappear. And Brown's supposed reverse Norquist presupposes that people still value the services they are receiving -- including the affordable quality education traditionally provided at UC. But California is no longer willing to pay for it. UC is not necessary for the upbringing of our very own jeunesse dorée (never was), and it no longer affords the middle class the means for upwards mobility, simply because social mobility increasingly works only one way in this country, i.e., down. So there you have it.
We agree. Here's what we wrote yesterday regarding Mark Yudof's testimony to the California senate budget committee:

At that point it becomes the new normal. In effect, it represents an attempt to limit political struggle to a relatively minor question about what's currently on the table -- everything else simply disappears.

Construction, Collateral, and Crisis [Updated]


We wanted to draw your attention to a few recent articles from the Daily Cal that caught our eye as they were published but together offer an insight into the priorities of the UC administration. Not that we need any help at this point -- we've read our Meister. But what the hell.

First, this article from last Friday that our compañeros at thosewhouseit caught as well. In it, UC President Mark Yudof declares that tuition could double if no tax increases are incorporated into Governor Jerry Brown's budget:
UC President Mark Yudof had a simple message to deliver Friday morning when he testified before the state senate's budget committee: If the legislature opts for an all-cuts budget to fill its remaining $15.4 billion deficit, "all bets are off" at the University of California.

If the $500 million cut already made to the university earlier this spring were to double to $1 billion under an all-cuts budget, Yudof said the 10 campus system would be put on a path that could lead to a mid-year tuition increase next January, employee layoffs, program closures throughout the university and -- ultimately -- a doubling of tuition to $20,000 a year.

Friday's committee meeting marked the first time Yudof has publicly acknowledged what the consequences of a $1 billion cut could look like, though Gov. Jerry Brown had predicted in April that tuition could rise to $20,000 or $25,000 under an all-cuts plan. Yudof agreed, saying to the committee that he had looked at the numbers until he was "blue in the face" and that "the governor is not far off in his prediction."
At this point, it's hardly news that the state has cut funding for higher education -- they've been doing it for decades. But this isn't about speaking out against cuts. It's about positioning. Yudof testified to the state senate's budget committee that "the system can absorb the initial $500 million cut" -- the one that has already been programmed into the UC budget for this year -- "but if the state increases the size of the cuts the university will have little choice but to raise tuition 'geometrically' and cut services." In addition to erasing the violence of austerity ("Don't worry about it, we'll be fine... as long as you only cut $500 million." Um, really?), this strategy charts a path of rhetorical retreat. Obviously this isn't a rousing defense of public education. But it leads to another danger: every time the budget is cut, it's a "disaster"... until the cuts go through. At that point it becomes the new normal. In effect, it represents an attempt to limit political struggle to a relatively minor question about what's currently on the table -- everything else simply disappears.

Now take a look at this article published in today's paper. It reports on the results of an audit of UC finances that shows the system's increasing liabilities relative to its assets. Of course, the UC administration isn't having any of it. UC spokesperson Steve Montiel, always ready for a vapid soundbite, tells the paper that "financially, the university is pretty strong." Thanks, Steve. But then we get this:
The report also states that capital spending -- funding that goes towards long-term assets that help in the production of future goods and services -- throughout the UC continues at a "brisk pace" in order to provide the facilities necessary to support the university's teaching, research and public service mission and for patient care.

Facilities include academic buildings, libraries, student services, housing and auxiliary enterprises, health science centers, utility plants and infrastructure and remote centers for educational outreach, research and public service.

Additionally, in 2010, $2.8 billion of debt was issued to finance and refinance facilities and projects at various UC campuses, though the report did not specify those projects.
Wherever there's a budget crisis, there's capital projects. The Daily Cal does an interesting job of translation here, with that little clause to tell us what "capital spending" is: it's spending, they say, that leads to accumulation. Another way of saying it would be it's spending that transfers the burden of debt from the university to the student. As Bob Samuels recently wrote, "In this modified credit swap, students are forced to take out subprime student loans, often charging 6 per cent interest, so that the university can borrow money at a reduced rate." And then there's that short sentence at the bottom on construction bonds, the debt issued by the UC to engage in further construction projects. Another $2.8 billion. And as usual there's little transparency -- no mention of where that money is going. Will it be used to pay for important renovations? Or new stadiums and laboratories? All we can do is guess, but at this point we have little reason to trust the UC administration's word on any of this. [Update Wednesday 5/11: The Chronicle just published a relevant article on the UC's maintenance backlog: "the university predicts it will need nearly $2 billion over the next five years to address capital renewal and deferred maintenance." There's not much analysis in the article about why this is the case, but it does note: "Money for capital projects at UC or CSU is often earmarked for specific projects, such as the $321 million bond for renovation of Cal's Memorial Stadium. None of that money can be used, for example, to repair the stairwell at the life sciences building." But presumably the administration could sell bonds dedicated to repairs -- the real question is why they don't. But in reality it's not much of a question at all.]

Once again, Steve Montiel: "'We've got great ratings services. The university has really high ratings from many ratings services,' Montiel said. 'I don't know there is any need to reduce liability.'" What ratings is he talking about? Bond ratings. As Bob Meister wrote back in October 2009,
Why haven’t you been told that UC has been using your tuition as collateral to borrow billions of dollars? The obvious reason is that tuition increases are justified (to you) as a way to pay instructional expenses that taxpayers refuse to pay. If that’s why they’re being imposed, it’s natural to assume that tuition increase will be used to minimize cuts to education. But when UC pledges your tuition to its bond trustee (Bank of NY Mellon Trust), it’s really (legally) saying that your tuition doesn’t have to be used for education, or anything in particular. That’s why it can be used to back UC construction bonds, and why the growth in tuition revenue, as such, is enough to satisfy UC’s bond rating agencies (S&P and Moody’s), whether or not UC can pay its bills. The effect of UC’s pledge is to place a new legal restriction on the use of funds that it must first say it could have used for anything, including education. Thereafter, construction comes ahead of instruction.

Some of UC’s new, and self-imposed, constructions costs will come off the top of its annual budget, despite this year’s “extreme financial emergency.” When UC chose t0 take on $1.35B in new construction debt for 70 projects in August 2009 -- one month after imposing employee furloughs that “saved” $170M -- it committed to spending $70-80M in extra interest payments for years into the future -- they’ve just released the interest rates for each new bond series. Earlier in the year, UC had already issued $.8B in tuition-backed bonds in spring 2009, only some of which were for refinancing older projects at lower interest rate. It’s thus likely that the interest due on new projects funded during 2009 alone will have eaten up more than half of UC’s “savings” from the furloughs. Would the furloughs have been “unavoidable” if UC were not secretly planning to incur additional interest expenses for new bond-funded construction?
Note that the graphic above shows that $2.5 billion of the UC's short-term liabilities are classed as "securities lending collateral." We're not entirely sure what this means, but it might refer to the $2.8 billion in construction bonds mentioned by Montiel. Why the $300 million difference?

Now that we once again have the UC administration's obsession with construction over instruction in mind, take a look at another article out of today's Daily Cal. This one is about the ongoing process of developing a plan for renovating and redesigning Lower Sproul Plaza at UC Berkeley, a project that's budgeted at $223 million. And guess what:
As the exact design of the new Lower Sproul Plaza continues to form, an estimate of the cost for the current design is over budget by about $10 million.
The money for the project comes from a number of sources: "contributions from the campus, the UC Office of the President and student fees approved . . . in the 2010 ASUC General Election." In other words, not only are students paying directly for the project -- after all, we voted for it! Democracy in action! -- we're paying for it indirectly as well, through tuition increases that have already taken place (that money goes into the general fund) and the promise of future tuition increases that the UC now owes the bond raters.

This isn't about budget cuts -- it's about priorities.

Hunger Strike for Ethnic Studies Begins at UC Berkeley


This afternoon, after a joint teach-in on the administration's plans to consolidate Gender and Women's Studies, Ethnic Studies, and African American Studies, a group of nine students began a hunger strike in front of California Hall. Some of the strikers are veterans of last year's hunger strike as well. Their demands are the following:
1. Reinstate the FTE staff positions in Ethnic Studies cut by organizational simplification under Operational Excellence
2. End the current process of Operational Excellence
3. Publicly support the Legislative Resolution ACR 34, co-authored by Ricardo Lara and Luis A. Alejo in Support of Ethnic Studies in California.
4. We demand that the administration publicly acknowledge the unfulfilled promise of the creation of a Third World College at UC Berkeley.
The administration has released an official response, which is available here. As expected, it not only treats the strikers like irrational children, but furthermore completely fails to respond to their demands. Instead, it tries to make them disappear by asserting that, despite all available evidence, the administration in fact shares the same goals: "Our hope is to understand one another better, given that we have the same ultimate goals for equity and inclusion." Oh really. Flashback to Yudof's recent comments on what he called the UC's "compass points":
Yudof said the university has long operated on three "compass points" -- access, affordability and excellence.

"We are moving dangerously close to having to say: pick two of the three. That’s my view, and the excellence is nonnegotiable," he said. "We are going to have to look at access and affordability."
But we don't need to pick over the statements of UC administrators -- we have enough evidence right before our eyes. The fact is that through "Operational Excellence" UC Berkeley paid millions of dollars to the consulting firm Bain & Company to identify areas to "streamline" (that is, cut). As thosewhouseit reported earlier today from the hunger strike:
This afternoon, over 100 members of a coalition in defense of Ethnic Studies gathered at Sather Gate against the impending consolidation of their departments as part of Operational Excellence. OE, it should be noted, has now been exported to UCSB, UCSF, UC Davis, and UCLA.  We now have “Organizational Excellence,” “Operational Efficiency,” and God knows how many other variants. If Berkeley shelled out a cool $7 million to Bain, UCLA is using Huron, Davis ScottMadden Management, and Santa Barbara an “individual consultant.” Against this affront to Ethnic Studies under the guise of austerity, the 100-200 students and their faculty allies marched to California Hall after announcing the inauguration of a hunger strike. Eight students are now on hunger strike and stationed in front of California Hall.
There's one more piece of the administration's response that's worth noting. The concluding paragraph reads:
We are concerned that some students would endanger their health [or safety!!?!] by a hunger strike, and/or negatively impact their academic performance at the end of the semester. We have offered to meet with a small representative group, and this offer remains on the table. In the meantime, you are able to exercise free speech and protest, but are also bound by the campus rules on time, place, and manner (http://police.berkeley.edu/about_UCPD/news/news_101006.html). These rules preclude overnight lodging or camping.
Behind austerity measures, the threat of riot cops. But the administration's discourse is inherently paternalistic, even when it's actively engaged in threatening its students. This is reflected, to begin with, in the concern over "health [and safety]," a keyword that's been deployed frequently against student protest over the last year and a half. It also appears in the notion of "time, place, and manner" regulations, which proclaim the importance of free speech while relegating it to geographically isolated and temporally restricted areas. This is the logic of the "free speech" or "first amendment zone." Time, place, and manner -- a subject for a future post.

"Public" [Updated]

The sit-in at the administration building of CSU Fullerton, which began on Monday evening, continues and is currently in its fourth day. Protesters are demanding that CSUF President Milton Gordon sign a "Declaration to Defend Public Education." Gordon's response: "I won't be able to sign this agreement." According to the CSUF paper, the Daily Titan, CSUF administrators justified their stubborn refusal with reference to the language in the statement relating to fair contracts and union negotiations:
Questions arose over the California Faculty Association’s involvement in the meeting and in the drafting of the declaration. Both President Gordon and acting Vice President for Student Affairs Silas Abrego suggested that the meeting itself was a CFA function.

“The declaration makes reference to the CFA,” said Abrego. “There are ongoing negotiations going on right now. There is representatives for the CFA and the CSU in negotiations, we can’t have anyone else intervene in those negotiations.”

Abrego added that the document was a way to generate support for the CFA and attendees were commingling two issues ­-- for a better contract and better education.

After the issue was discussed, two CFA members who were present removed themselves from the room.

Gordon continued to stress that he would not sign the statement or any agreement at all despite the pleas of students and faculty.
The union issue is clearly an important one. At the UC we've seen administrators literally slam the door in the face of union members. But Gordon's continued rejection to sign anything at all -- he refused to "sign the statement or any agreement at all" -- even after the CFA members had left voluntarily suggests that there's something more at stake in the standoff.

It's the word "public."

First take a look at the Declaration, written by students, faculty and staff from CSUF, CSU Long Beach, CSU Los Angeles, Compton College, Fullerton College, and Mt. San Antonio College. The first part of the statement is a sort of general preamble:
“Education is a social process. Education is growth. Education is not a preparation for life; education is life itself.” John Dewey

We, the students, staff, and educators of California’s public schools,colleges, and universities, call upon the people of the state to recommit to and reinvest in public education as the principal foundation of a democratic society.

Public education is a sacred trust and needs to be protected from those who would see the state divest even further from its constitutional obligations.

Public education is a public good and needs to be protected from the for profit interests of the private sector.

We call upon the people of California to recognize that, though an educated workforce is essential to our prosperity, education itself has a social value that cannot be reduced to monetary considerations alone.

Public education brings together diverse communities of educators, staff and students in ways that prepare learners for a productive yet socially responsible life.

Public education creates spaces that promote the intellectual and emotional development of tolerant, critically-engaged citizens.

Public education is by definition open to all Californians, regardless of geographic location or socio-economic status, and is thus the very cornerstone of a vibrant, principled, and fundamentally compassionate democracy.
This is not, whatever these administrators might mistakenly think, a particularly radical statement. Even apart from the fact that a statement is all it is -- it's not legislation or a policy decision, it doesn't lock Gordon into doing anything at all -- it amounts to a simple acknowledgment of the value of public education. And its public character is heavily emphasized: every paragraph but one (notably, the one that talks about economics and "monetary considerations") includes the word.

Now compare the Declaration to the statement that President Gordon made in a follow-up letter to the editor that was published yesterday in the Daily Titan:
I commend students for their active engagement in critical issues facing our university and the CSU during these challenging fiscal times. I agree with and support many of the points of the Declaration to Defend Public Education and encourage all students to ensure that their voices are heard.

Your amplified demands for quality education are timely and provide a significant opportunity to maximize the importance of this message to the people and government leaders in the state of California. In your recent call for action through peaceful demonstration April 13 and during our meeting that day, students exemplified the values we embrace at Cal State Fullerton -- civic engagement, positive interaction and dialogue with faculty, staff and administration, as well as civility and respect for those whose opinions differ from your own.

The state budget crisis is at the heart of the fiscal challenges we face. Lessening its effect on the CSU continues to be the highest priority of the CSU chancellor, the CSU presidents and other leaders of our system. Despite this year’s increase in tuition fees, the cost of a CSU education remains the lowest of comparable institutions around the nation. At the same time, one-third of these tuition fees are set aside for the neediest of students, which serves to preserve access to higher education for those who can least afford it.

I am committed to continuing to work toward access to a high quality university education and to keeping the lines of communication open as we work through these difficult times together. Please continue to take an active role in support of providing quality public education for all deserving students.

The word "public" appears once, aside from the place where he mentions the name of the document that he's refusing to sign. Just once. And take a careful look at that sentence: "Please continue to take an active role in support of providing quality public education for all deserving students." It is only students who must "continue" to support public education -- he's most definitely not saying anything about himself or his administration. This is an incredibly revealing statement.

In place of "public," Gordon seems very comfortable with the word "quality." Not a public education, but a "quality education" is what he wants his CSU to provide. What comes to our mind is the recent statement by UC President Mark Yudof regarding what he called the UC's "compass points":
Yudof said the university has long operated on three "compass points" -- access, affordability and excellence.

"We are moving dangerously close to having to say: pick two of the three. That’s my view, and the excellence is nonnegotiable," he said. "We are going to have to look at access and affordability."
What Gordon, Yudof, and other administrators are talking about with their vague, bureaucratic language is privatization. Yudof says it outright, marginalizing and putting up for negotiation the categories of access and affordability. Gordon, on the other hand, continues to speak of "access," but does so in the context of a sort of generalized resignation, a complete acceptance of the talking point that this sort of thing is "inevitable." Budget cuts at the state level cannot and will not be fought. He says it outright: the job of the CSU administration is not to combat these cuts but rather to "lessen their effects." University administration has become a task of restructuring, of imposing austerity, of privatizing, of moving the financial burden onto the backs of students and workers. It has become a corporation, with corporate salaries and perks from foundations.



Why doesn't Gordon want to sign the Declaration? Not because of the CFA, or ongoing negotiations. It's because he doesn't want to use the word "public." At best, he believes it's outdated or obsolete; at worst, he thinks it doesn't work, that is, that education shouldn't be public. Regardless, we can now say that it's become official: CSUF President Gordon does not support public education, period. It's that simple.

[Update Thursday 1:34 pm]: This op-ed by Peter Cornett in the Daily Titan is pretty on point and seems to be the source of the data in the above tweets.

[Update Friday 11 am]: The sit-in has finally ended, after President Gordon gave in and agreed to sign a statement. Note that he did not sign the original "Declaration to Defend Public Education" that we looked at above but rather a revised "Statement in Defense of Public Education." At first glance, the changes seem fairly minor. But that doesn't mean they're not significant. Check out, for example, the one part where the text refers to administrators. Here's the original Declaration:
A commitment from administrators, school boards, teachers unions, staff unions, student organizations, parent groups, professional associations, community-based organizations, and postsecondary institutions to work together with the State to provide quality education for all people regardless of gender, economic, social, ethnic, or racial status.
And the revised Statement:
A commitment from administrators, school boards, teachers unions, staff unions, student organizations, parent groups, professional associations, community-based organizations, postsecondary institutions and state leadership to provide quality education for all people regardless of gender, economic, social, ethnic, or racial status.
What strikes us here is the way the revisions enable a shift of responsibility away from administrators et al. While the original Declaration makes it clear that administrators must commit to working "with the State" (e.g. lobbying), in the revised Statement the state is incorporated into those actors that directly "provide quality education" (there's that word again). Administrators are, to some extent, off the hook. The revised statement thus fits with our earlier analysis of Gordon's letter to the editor (which, it should be noted, remains the clearest example of his own position on "public" [read "quality"] education), inasmuch as the responsibility can now be laid at the feet of the "state leadership" and budget cuts remain out of reach, inevitable.
