‘Our brother died without a will, and his widow wants to sell the family farm. Can we stop her?’

‘If the house and farm were registered in the joint names of your brother and his wife, as would be quite common with married couples, then the property would pass to his wife by survivorship, and the children would have no claim to any share of it’. Photo: Getty

Query: Dear Mary Frances, my brother died last year and was farming the home farm after our parents signed it over to him a number of years ago.

Myself and my siblings had no issue with this, as the brother was always farming mad and never wanted to do anything else and it meant the farm was being kept in the family. We have always enjoyed returning home at various weekends as he lived in the family home with his wife and young children.
