Con­sis­ten­cy Re­quire­ment / Mar­gin Squeeze

According to Section 27 of the Telecommunications Act (TKG) the Regulatory Authority shall take care that rates regulation measures in their eintirety are coordinated (consistency requirement). In particular, the Regulatory Authority shall coordinate the timeframes and the content of its measures and considerwheter each measure is proportionate to the aims according to section 2(2).

Against this backdrop, on 20 May 2009, the Agency put a draft on consistent rates regulation up for discussion as Notification 292 in Official Gazette 9/2009. Eight statements were received from telecommunications companies and other organisations and published on the Agency’s website. These statements were first summarised and evaluated. The evaluation of the hearing will be published in parallel, given that explanatory additions made on this basis have been incorporated into the statements.

The final version of the "Notes on consistent rates regulation within the meaning of Section 27 subsection 2 of the Telecommunications Act" has been published on 4 November 2009 as publication 548 in the Official Gazette 21/2009 and on the website of the Federal Network Agency. The evaluation of the public consultation has been published simultaneously. The following paper is intended to help establish a common understanding of the underlying problems and present guidelines for the application of margin squeeze tests.

Furthermore, a paper on margin squeezes as defined by section 28(2) TKG was put to discussion on 20 December 2006 as publication 441 in the Official Gazette 24/2006 and on the website of the Federal Network Agency. A total of 13 statements were received from telecommunications companies and other organizations that were published on the website of the Federal Network Agency (only available in German ). They have been consolidated and evaluated. Additional information was subsequently incorporated into the paper on this basis by way of explanation.

The final version of the "Notes on margin squeezes as defined by section 28(2) para 2 TKG" has been published on 14 November 2007 as publication 940 in the Official Gazette 22/2007 and on the website of the Federal Network Agency. The evaluation of the public consultation has been published simultaneously. The following paper is intended to help establish a common understanding of the underlying problems and present guidelines for the application of margin squeeze tests.
