The #SEC decision Securities and Exchange Commission v. Jarkesy handed down by #SCOTUS last month is an important decision for the health care industry and could potentially weaken agencies’ authority. Our Washington, D.C. partner Brian Bewley was quoted in POLITICO Pro’s article titled “The Supreme Court’s under-the-radar health care ruling.” Brian explained that the ruling “will enable entities and individuals subject to OIG penalties to challenge the constitutionality of administrative proceedings and the fines themselves,” with the FDA also facing similar challenges. Additionally, the decision could make it harder for agencies to bring administrative actions moving forward. “This decision undoubtedly will make it more challenging for OIG to bring these types of actions as OIG must now recognize that the process by which OIG pursues and adjudicates these [civil monetary penalty] matters will be challenged as unconstitutional by defendants in these actions,” according to Brian. “The government’s resources are limited, so this will have a chilling effect,” he added.
