Home Economics: My tree overhangs my neighbour’s garden but he won’t let me cut it. Am I liable if it falls in a storm?

We have a large beech tree in our garden, which we love, but it hangs over our neighbour’s fence quite heavily. We have told him we have no problem with him cutting it back, but he says he likes it.
