Introduction

This collection covers more than 60 national jurisdictions, and a vast amount of international judgments and decisions from international and regional courts and tribunals as well as the United Nations.  It is not an exhaustive repository of all national and international jurisprudence but cases are selected based on their significance in the sense that they state a novel proposition of law; articulate existing legal principles in an especially persuasive or clear manner; or apply existing legal principles to new or unusual factual circumstances. Decisions in which UNHCR intervened are also included in this collection with a link to the court intervention where available.  It also re-publishes jurisprudence that may assist in the assessment of claims for international protection. It is therefore important to note here that UNHCR does not necessarily endorse any, or part, of the re-published information made available on Refworld.

Where possible, case law summaries are provided to give a content indication of a decision. This is provided on a voluntary basis for informative and accessibility purposes only and any reference should be made to the original text of the decision itself.

Court Interventions / Amicus Curiae

Interventions before courts by UNHCR and other organizations are an important tool through which protection standards can be developed and a consistent application of refugee law fostered. Interventions before courts may take different forms, depending on the national or supranational context, including formal amicus curiae briefs, advisory opinions or letters to the court or parties involved, as well as public statements. Interventions by UNHCR are carried out in the exercise of its supervisory function.
