Trump's threat : Is it safe to transfer visa ? : your answer is simple

1: Based on current political status is it safe now for H1B Transfer?

• I will say yes it is, I am not saying because that I am into the IT services but until the consultant/employer/company shows that they are very important to that very project along with unique skill sets / updated version of the skills.
• Get the all the necessary docs from the company who transfers your visa. (Offer and employment letter, LCA initiation copy, Offer confirmation email copy (tier one vendor will get it from the end client – this will help employer to avoid some bitter circumstances)) to make yourself comfortable before putting your papers to the present employer.

2: I can only do H1B Transfer provided Receipt Notice

• Most of the companies understand the consultants concern. Here is the company’s point of view, International standard of notice period is just 2 weeks / 15 days to start new project. Whereas if you put the notice after your receipt it would take one month (30 days )of time to make the consultant join with the new project since the receipt / EAC number would take minimum 2 weeks to receive. No client will wait until you join because always clients have the backup plan. If the company have good rapport with the vendor/ client, it can postpone your start date just for a maximum one week.
• More over Employer / H1 Transfer Company spends $5000 + attorney cost/Fee to file your H1 Transfer petition. Trust, no company will spend $5000 if it is highly risk.
• Consultants can get the papers (Offer and employment letter, LCA initiation copy, Offer confirmation email copy (tier one vendor will get it from the end client – this will help employer to avoid some bitter circumstances)) then they can send notice to present employer. Consultant should choose the good companies to transfer their visa.

3: Is it 2 weeks enough for H1 Transfer?

Yes, here you go the actual process. Sales person has to market, submit your profile, follow up and get the interview. Once the consultants got selected in the interviews,

1st Process (Day 1): - Get the offer confirmation from the client.

2nd Process (Day 1):- You should send the H1B transfer documents to company’s attorney and to the company who transfers your H1B visa.

3rd process (Day 2):  Company will file your LCA and will send you a confirmation email stating that your LCA is filled.

4th process (Day 2): - You should put your 15 days resignation (Two Weeks Notices Period) with your present employer immediately, provided the company sends you the LCA confirmation email. You can also ask other proofs or docs to send your resignation to present employer to make you more comfort to take that new role.

5th Process (Day 2): - You should forward the resignation email to the company who transfers your visa, which you had sent to the present employer.

6th process (Day 9): - We will get you the LCA. Basically LCA approvals take 5 to 7 days.

7th Process (Day 10/11): - If the company files the H1 transfer petitions the same or next day of the LCA approval, it would take 3 days to receive EAC number and the company who transfers your H1B will get you the EAC number.

8th process (Day 15/16): - You should join the new project. Most of the times the start date will be after 2 weeks from the date of offer confirmation. That 2 weeks would be enough for H1 transfer.

You can join with new roles upon the receipt notice. You don’t need to wait for your case approval. It may vary in some cases.

People who already in USA (H1B holders), this might be a booming time where as there are many new roles opening up.
