Stanford Law School and the Inter-American Dialogue organized a virtual discussion with current and former magistrates from Brazil, Ecuador, and El Salvador on the role of the judiciary in electoral contexts in Latin America. In recent years, several democratically elected leaders, once in power, have turned their back on basic guarantees such as electoral integrity, freedom of expression, and judicial independence. The silver lining of such decline has been the work of independent courts that have acted as a check on the abuse of executive power. In this article, Professor Benjamin A. Schupmann from Yale-NUS College presents his book "Democracy Despite Itself: Liberal Constitutionalism and Militant Democracy." He discusses how antidemocrats exploit legal processes to undermine democratic institutions, emphasizing the importance of militant democracy measures like constitutional unamendability and political disqualification. These safeguards are crucial to defending against internal threats while preserving democratic values. Schupmann’s analysis is essential for understanding how to protect democracy in the face of rising illiberalism. This piece is excellent and provides concrete changes to our governance structures so that a multiracial democracy can be realized. It’s more than a reliance on hope or goodwill using executive orders and calls upon real change to legal standards, how we analyze budget and legislative decisions and strong proactive and apparatus to deliver equal protection.
If our democracy is to survive death by a thousand cuts – through a stagnant Constitution, partisan gridlock, and rule by an appointed Supreme Court minority – we must do more than defend. We must assume a new role as founders of a truly #Multiracial #Democracy that delivers for all. We must remake the systems and structure of governing—the values, laws, practices, indicators, and legal standards—so that serving all becomes the norm. Check out the latest installment in the Realizing a Multiracial Democracy for All series – "What It Means to Govern for All" by Judith Dangerfield. https://lnkd.in/gKn_Mg9t
