I do not always side with noyb, but in this case I salute them, Max Schrems, and the Irish DPA for being on the right side. It is simply not acceptable to try and perform a wholesale appropriation of publicly shared user posts for AI training on an opt-out basis, and even then trying to manipulate people by hiding the opt-out option from them in the most sophisticated way possible. The original purpose of people posting on social media was to inform other people, not to train Meta's commercial AI products. Therefore, such subsequent reuse of personal data for an originally unforeseen new purpose should require an opt-in, not an opt-out, especially not in the "boss-level dark pattern" style Meta tried to use here, to borrow the expression from Lilian Edwards. Awkwardly, in their press release, Meta says that they are "not the first company to do this – we are following the example set by others, including Google and OpenAI, both of which have already used data from European users to train AI. Our approach is more transparent". In other words: "Our manipulative tactics are better than those of the competitors, why don't you like them?"

Have you recently received a suspicious email from meta? Meta informed that their privacy policy is changing, and all user data published since 2007 will be used to train artificial intelligence. No more details. To express disagreement, you had to fill out a form that beautifully followed all the "dark patterns" and required completing 11 steps. And even then, there was no guarantee that your opt-out would be respected. These aspirations have been put on hold for a while (in EU), but for how long? Epoch AI calculates that AI systems could devour all of the internet's free knowledge as soon as 2026. Therefore, the development of artificial inteligence will face new challenges and new data will be needed - otherwise it will not be able to develop itself. Echoing some of my thoughts on the #eu #aiact earlier in the year, there seems to be some rapid "feedback" on the act coming into place, with #meta planning to not release all the features their more advanced #ai model, a multi-modal version of #llama. Meta have concerns over the "unpredictable" behaviour of regulators, coming soon after it was ordered to stop training its models on posts from #facebook and #instagram users in the #eu. This potentially opens up more opportunities for #artificialintelligence development in the #UK for anybody wanting to leverage this technology. However, as the UK also complies with the #gdpr, perhaps we will also get similar treatment in the near future. #AI represents the “biggest commercial opportunity” in today’s economy, according to research from #PwC, which predicts that global GDP will be 14 per cent higher in 2030 because of it, the equivalent of an additional €14.6 trillion. #Meta says there’s a huge opportunity in the “super competitive” artificial intelligence market, with the tech giant spending up to €37 billion this year on developing infrastructure. “There is a specific view in the EU, we are discussing, but we respect the decision.” The regulator move came as Austria privacy organisation #NOYB filed complaints with #privacy watchdogs in eleven EU member states, alleging Meta’s practices were not compliant with the EU’s General Data Protection Regulation (#GDPR). Describing it as a “step backwards” for #European #innovation, Meta says it remains highly confident that its approach complies with European laws and regulations. 

“Meta is no stranger to controversy. Last year, it was fined a record €1.2 billion for breaching EU data protection rules. Now the tech giant has paused the rollout of its AI assistant in Europe, after the Irish Data Protection Commission told Meta to postpone its plan to use data from Facebook and Instagram adult users to train large language models. ‘We said, ‘It's sad that is your point of view.
