[Upcoming event] Ho Chi Minh City International Construction Arbitration Conference (HICAC) 2024 With the country's economy's growth, construction is seen as one of the key sectors undergoing significant breakthroughs and changes over time. However, disputes in this sector have been considerably increasing under this situation. According to statistics from the Vietnam International Arbitration Centre (VIAC), in 2023, construction disputes saw a significant rise compared to previous periods, ranking fourth among industries whose disputes were handled by VIAC. It can be said that most of the construction disputes have huge value and are immensely complicated. These disputes stem from different causes, such as disputes arising from issues on designing and consulting, claims for compensation due to delays or quality failures, and other claims for terminating contracts. Building on the success of HICAC 2023, the Ho Chi Minh City International Construction Arbitration Conference (HICAC) 2024 will be organized jointly by the Society of Construction Law - Vietnam (SCLVN), Vietnam International Arbitration Centre (VIAC), and the International Law Faculty of Ho Chi Minh City University of Law. The conference theme is “Construction contract and International Arbitration – When Legal traditions collide”. We are pleased to have assisted the Hon'ble Islamabad High Court in this case of first impression on whether or not an Interim International Arbitral Award is akin to an "Award" within the definition of the New York Convention on Recognition and Enforcement of Foreign Arbitral Awards of 1958, and the Recognition and Enforcement (foreign awards) Act of 2011, Pakistan. Faiz, Sharif & Shinwari LLP was represented by Rizwan Faiz Muhammad and Afzal Shinwari. The matter arose out of disputes from the construction contract of the M4 Motorway, whereby the contractor, China Water & Electric Corp (CWE), took the National Highway Authority (NHA) to international arbitration under the ICC rules, with the seat of arbitration as Paris, France. The preliminary matter before the sole Arbitrator was whether or not the decision of the Dispute Board (or DAB under the FIDIC contract) binding in nature, despite it being challenged by NHA upon issuance of a "Notice of Dissatisfaction", or NOD against such decision. The sole Arbitrator gave an Interim Award (i.e. without going into the merits of the main dispute) whereby he held that NHA was bound to pay the monies so ordered by the DAB, despite having issued a NOD. CWE approached the High Court for enforcement of the Interim Award, which was resisted by NHA on various grounds, including inter alia that the interim award could not be considered an Award under the 2011 Act as well as the New York Convention. The Hon'ble High Court accepted CWE's petition, and dismissed NHA's objections based on reading of the ICC Rules as well as international jurisprudence developed on the area of law. #arbitration #internationalarbitration #ICC #ForeignAwards
