𝗧𝘄𝗼 𝗥𝗲𝗰𝗲𝗻𝘁 𝗡𝗲𝘄 𝗬𝗼𝗿𝗸 𝗙𝗲𝗱𝗲𝗿𝗮𝗹 𝗖𝗼𝘂𝗿𝘁 𝗗𝗲𝗰𝗶𝘀𝗶𝗼𝗻𝘀 𝗛𝗶𝗴𝗵𝗹𝗶𝗴𝗵𝘁 𝘁𝗵𝗲 𝗙𝗲𝗱𝗲𝗿𝗮𝗹 𝗖𝗶𝗿𝗰𝘂𝗶𝘁 𝗦𝗽𝗹𝗶𝘁 𝗼𝗻 𝗪𝗵𝗲𝘁𝗵𝗲𝗿 𝘁𝗵𝗲 𝗠𝗰𝗖𝗮𝗿𝗿𝗲𝗻-𝗙𝗲𝗿𝗴𝘂𝘀𝗼𝗻 𝗔𝗰𝘁 𝗔𝗹𝗹𝗼𝘄𝘀 𝗦𝘁𝗮𝘁𝗲 𝗜𝗻𝘀𝘂𝗿𝗮𝗻𝗰𝗲 𝗟𝗮𝘄𝘀 𝘁𝗼 𝗢𝘃𝗲𝗿𝗿𝗶𝗱𝗲 𝘁𝗵𝗲 𝗡𝗲𝘄 𝗬𝗼𝗿𝗸 𝗖𝗼𝗻𝘃𝗲𝗻𝘁𝗶𝗼𝗻 ℹ️ Two recent decisions from the Southern District of New York highlight the conflicting approaches taken by federal appellate courts on the issue of whether the McCarren-Ferguson Act permits state insurance laws to invalidate arbitration agreements governed by the New York Convention. The SDNY followed Second Circuit precedent holding that state insurance law controls. But the First, Fourth, Fifth, and Ninth Circuits have held that the New York Convention preempts state law. The SDNY’s decisions are now on appeal to the Second Circuit, which has the opportunity to align itself with its sister Circuits. Otherwise, the U.S. Supreme Court may take up the issue to resolve the circuit split.
