Ahead of the WNBA (Women's National Basketball Association) Draft and the highly anticipated season kick-off on May 14, Amazon Prime Video and the league have extended their media rights agreement for two more years 🏀 Under this renewed partnership, Prime Video will be broadcasting 21 games in the 2024 season, up from 20 in the previous deal. This includes the championship game of the 2024 Commissioner's Cup! With the Amazon deal in hand, the WNBA remains in the market for its next primary media rights deal. In a recent article, O&O's resident Mystic Meg Sean McGuire, looks at the next batch of sports rights deals. "... committing to a decade-long deal, with regular escalators in fees, is exactly what blew up the regional sports networks.  In today’s climate, any model that depends on a combination of broadcast advertising and cable revenues over the next ten years is risky, to say the least." Back in October 1993 when I was conceiving what became Fox Sports Australia we predicted this issue. The fear was that, as in the UK, when Sky had bought the Premier League rights over the BBC that the free to air media industry could be decimated by new satellite delivered services. I recommended that, in the best interests of dedicated sports fans, we should have a list of the most popular sports and events that should be sacrosanct and immune to new over-the-top services. This led to the anti - siphoning regime being implemented to ensure fair play... ...with the passage of time, priorities change, but we need to rely on the intelligence and integrity of the lawyers and politicians. Although today the war is fought over data, rather than content rights, but without eyeballs or users no-one has a business. In a civilised society, it is critical to ensure that these long-mandated provisions are policed for the greater good.

The Big East is finalizing a new six-year media rights deal with FOX Sports, NBC, and TNT, which is expected to increase from its previous $500M contract significantly. A couple musings on the deal: ◾The BIG EAST Conference, with four of the last eight men's D-I basketball championships, shows the value media companies place on basketball, though football drives media rights money. It'll be interesting to see how this deal compares to football-centric ones like the AAC's $1B deal with ESPN. ◾Adding multiple network partners boosts potential nationwide viewership, similar to the Big Ten Conference. ◾With the Big East deal nearly done, the Mountain West Conference is next, likely seeing an increase from its current $45M annual deal with CBS/Fox. I think any of us who were NBA fans in the 90s are excited about this potential deal for one reason - the return of the NBA on NBC theme song 🎼 I hope you can hear it in your head. I should play it each morning before I walk into work to get pumped up 💪 It's called "Roundball Rock" and it's reportedly owned by John Tesh. He had said that he made over 6 figures in royalties each year that the NBA used the song. That was well over 20 years ago that the NBA left NBC, and the song has been used here and there since then (including in an SNL skit). I can confidently say that the people will DEMAND it be the theme song for future games if NBC receives the rights. If he hasn't already, this is why any rights holder should make sure their royalties are taken into account in their estate plan, because the Tesh estate may be about to see a (perhaps unexpected) big boost! A couple things to think about when estate planning for royalties: 💡 Try to estimate the value The total value of the rights will need to be valued for estate tax purposes eventually. It would be a good idea to have it appraised during lifetime to see the impact on your plan. Of course, valuation wouldn't necessarily take into account a billion dollar company picking up the rights - so, in this case, John Tesh may have benefitted from gifting while the rights may have not been worth as much. 💡 Have an idea of the potential burden on the beneficiaries and trustee and determine if maybe auctioning them rather than transferring them to individuals at death is better Processing checks, tracking payments, monitoring and enforcing legal rights - these are all burdens of the right's holder that will require labor and expense. Perhaps directing the trustee to auction the rights could make everyone's life easier (with some risk). #estateplanning
