I am ecstatic to announce that my student note, "The Killing of Ayman al-Zawahiri: On Its Legality and Why the U.N. Should Clarify the "Unable or Unwilling" Doctrine" was published in Volume 56 of the Case Western Reserve University Journal of International Law. I am deeply grateful to the JIL editorial team for dedicating time from their incredibly busy schedules to help me refine my work over the past year and a half. When I joined the Journal I made it my goal to explore and share knowledge about my Middle Eastern roots and culture. This passion guided my decision to focus my student note on the region's history, politics, and legal challenges, aiming to foster a deeper understanding and appreciation within the legal community. My journey with the journal and writing my note has been instrumental in shaping my perspective and commitment to advancing understanding and dialogue on Middle Eastern affairs. On July 31, 2022, a drone strike ordered by the Biden Administration successfully targeted and killed Ayman al-Zawahiri, the leader of al-Qaeda, in Kabul, Afghanistan. This action marked a continuation of U.S. policy to pursue and eliminate al-Qaeda operatives worldwide, a strategy that has been in place since the September 11th attacks. Despite this, the United States did not submit an Article 51 notification to the United Nations to justify its use of force in Afghanistan. The U.S. claimed that the Taliban was "unwilling or unable" to mitigate the threat posed by Zawahiri, highlighting a gap in international law regarding such determinations. In my note, I explore the legal justifications for the strike using the Deeks Factors Test for "unable or unwilling" scenarios. Additionally, I propose the adoption of a U.N. Resolution to create a clear and standardized framework for states to follow when dealing with non-state actors. You can read my article here:
