International Attorney, LL.M. in International Legal Studies (University of Vienna), Admitted to the Bar (Peru)
🙌 What a perfect balance between insightful and entertaining! 🙌 Last Tuesday, the ICC Arbitration YAAF hosted a “Breakfast with Claudia Salomon”. This event was an incredible opportunity to hear directly from Claudia Salomon about the ICC's vision and the future of arbitration. She generously shared her experiences and offered valuable tips. Here are some of my 🔑 takeaways: 💡 Future 🚀 the current cases reflect business deals made 2-5 years ago. We must consider this when anticipating future disputes. 💡 Diversity 🌱 the conversation has evolved beyond just gender to include individuals not limited by geography. 💡 Trust 🤝 is the primary reason companies and in-house counsel choose specific arbitral institutions for their arbitration proceedings. 💡 Tips 📝 to secure arbitral appointments at the ICC: - 👉🏻 Initially, focus on gaining experience and being an excellent counsel. - 👉🏻 Be strategic and maintain a clear, focused personal brand. Thank you Paul Hauser and Dr. Anna Kaehlbrandt for being ⭐ top ⭐ moderators and to Clifford Chance for hosting. #arbitration #icc #futuredisputes #disputeresolution
☕ This week, we were joined by Claudia Salomon, president of the ICC International Court of Arbitration and the first woman President of the ICC Court in its 100-year history, for a Breakfast Talk in our Frankfurt office. She shared insights on her role as president of the ICC Court as well as the chances and challenges that come along with it. Furthermore, she gave us insights into her everyday work at the ICC Court and her take on the current developments and hot topics in international arbitration. The discussion was moderated by Paul Hauser, our partner and ICC YAAF Representative for Europe, as well as Anna Kaehlbrandt, Associate at Hengeler Mueller. A heartfelt thank you to Claudia Salomon for her inspiring words and to all participants who contributed to the lively discussions. The event underscored the importance of mentorship and knowledge-sharing within the ICC Young Arbitration and ADR Forum (YAAF) community. #ICCYAAF #InternationalArbitration

An appeal to those interested in the practice of arbitration particularly from Namibia to participate in training such as this. The practice of arbitration is notably absent in jurisdictions such as Namibia, which is more focused on litigation in courts. NamPower and many other institutions, have however, included in its commercial contracts that alternative dispute resolution processes should first be followed in any dispute between contracting parties - it is not lost on me, that I type this as I am in an arbitration. As a final point I met Madam Adekoya and what a power house in the field of arbitral practice. If you can join the training, do so.

It was a pleasure to participate in 2023 Hong Kong Arbitration Week and share observations on ongoing changes in relation to the selection of arbitral seats. The Asianisation of arbitral seats remains the main trend in the disputes involving CIS parties. Many thanks to Dmitry Kaysin for dynamic moderation of the discussion and distinguished co-panellists, Dr. Christopher To, Brad Wang and Mark Tushingham, for their valuable insights. #HKAW2023 #hongkong #arbitration #hkiac #RGD

Delighted to see the publication of the SCC Arbitration Institute 𝐏𝐫𝐚𝐜𝐭𝐢𝐜𝐞 𝐍𝐨𝐭𝐞 𝐨𝐧 𝐒𝐞𝐜𝐮𝐫𝐢𝐭𝐲 𝐟𝐨𝐫 𝐂𝐨𝐬𝐭𝐬 𝟐𝟎𝟏𝟕–𝟐𝟎𝟐𝟐: https://lnkd.in/eUt44cig (authored by Jake Lowther and Gaurav Majumdar) ✔️ When approaching the topic of 𝐜𝐨𝐬𝐭𝐬 𝐢𝐧 𝐢𝐧𝐭𝐞𝐫𝐧𝐚𝐭𝐢𝐨𝐧𝐚𝐥 𝐚𝐫𝐛𝐢𝐭𝐫𝐚𝐭𝐢𝐨𝐧 𝐚𝐧𝐝 𝐚𝐜𝐜𝐞𝐬𝐬 𝐭𝐨 𝐣𝐮𝐬𝐭𝐢𝐜𝐞, 'security for costs orders' is probably the first topic to come to mind - in the words of an SCC arbitral tribunal, the assessment of whether exceptional circumstances exist involves a balancing exercise between the right of a party to pursue its claim against the right of an opposing party to recover the costs, considering access to justice. ✔️ Out of 𝟑𝟎 𝐚𝐩𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧𝐬 for security for costs between 2017 and 2022, 𝐨𝐧𝐥𝐲 𝐨𝐧𝐞 𝐰𝐚𝐬 𝐮𝐩𝐡𝐞𝐥𝐝 by SCC arbitral tribunals, in light of the exceptional circumstances of the case. 💡 This and other issues pertaining to costs and access to justice, will be discussed at ICCA 2024 Hong Kong, with Aloysius Llamzon, Thomas Stouten, Ruth Stackpool-Moore, Rodrigo Garcia da Fonseca, Joanne Lau, and Dr Crina Baltag, FCIArb. #arbitration #costs #ICCAHK2024
