FERC Issues Two Historic Rulemakings to Revise Transmission Planning, Cost Allocation, and Siting Policies During a Special Open Meeting on May 13, 2024, the Federal Energy Regulatory Commission (FERC) issued two significant rulemakings that promulgate reforms to support the expansion of transmission infrastructure needed to meet the country’s changing resource mix and growing energy demands while ensuring a reliable grid.    First, FERC’s new transmission and cost allocation rule, Order No. 1920, requires public utility transmission providers to conduct long-term transmission planning for regional transmission facilities and to determine how to pay for them.    Second, FERC’s new transmission siting rule, Order No. 1977, revises the Commission’s regulations governing applications for permits to site transmission facilities to conform to the rules set by the Infrastructure Investment and Jobs Act (IIJA) amendments to section 216 of the Federal Power Act (FPA) and to clarify and modernize certain regulatory requirements relating to FERC’s exercise of its backstop transmission siting authority under the Energy Policy Act of 2005.    The Order No. 1920 reforms can be broken down into three categories: (1) Long-Term Regional Transmission Planning over a 20-year planning horizon; (2) cost allocation in accordance with beneficiary pays principles; and (3) additional reforms aimed at enhanced transparency in local transmission planning, “right-sizing” of transmission projects, and interregional transmission coordination to support the development of cost-effective projects.    While Order No. 1920 adopts the majority of the proposals set forth in the underlying April 21, 2022 Notice of Proposed Rulemaking (NOPR), there are several key differences between the NOPR and the final rule. First, Order No. 1920 does not require transmission providers to seek the agreement of states regarding the cost allocation method to be applied to Long-Term Regional Transmission Facilities, although the new rule does provide for a six-month engagement period with states. Second, Order No. 1920 declines to limit eligibility for Construction Work in Progress rate recovery for transmission facilities selected during the Long-Term Regional Transmission Planning, as was proposed in the NOPR. Third, Order No. 1920 declines to adopt the NOPR proposal to permit the limited reinstatement of the federal right of first refusal (ROFR) for incumbent transmission providers who establish joint ownership of transmission facilities. Leeward Renewable Energy, alongside California's PG&E, has established a pivotal long-term agreement ensuring resource adequacy for a substantial PV co-located Battery Energy Storage System (BESS) in Arizona. This 15-year commitment encompasses the energy generated by the Sierra Pinta BESS project in Yuma County, Arizona, boasting a capacity of 112.5MW/450MWh and slated to commence construction in September, aiming for commercial operation in the first half of 2025. Resource Adequacy (RA) agreements, such as this, are vital mechanisms within the CAISO market, allowing resources to commit their capacity to meet demand requirements, bolstering reliability without reliance on centralized Capacity Market (CM) auctions. Arizona's landscape is witnessing a surge in grid-scale BESS initiatives, driven by long-term Power Purchase Agreements (PPAs), tolling agreements, and RA commitments. Notably, Plus Power secured tax equity for a 360MWh project in May, followed by Longroad Energy's commencement of an 855MWh system in March. Additionally, a 1GWh project came online during the same month, claiming the title of the state's largest endeavor in energy storage. The California Public Utilities Commission has allowed renewable energy systems to connect into the grid via Limited Generation Profiles (LGPs). This approach aims to reduce the need for costly infrastructure upgrades and support more renewables on the grid by leveraging California’s public grid data. California utilities must create hourly capacity models for each node on their distribution system, known as an Integration Capacity Analysis. The new ruling allows developers to utilize these analyses to generate LGPs for projects. The LGPs will specify the maximum generation that a DER system can export at different times, ensuring project responsiveness to varying grid constraints. Statement from Solar and Storage Industry Regarding Introduction of Fixed Charges on California Electric Bills The California Public Utilities Commission (CPUC) has approved regulations mandating new monthly fixed charges on electricity bills for residents. Those eligible for the California Alternate Rates for Energy (CARE) and Family Electric Rate Assistance (FERA) programs will face $6 and $12 monthly charges, respectively, while all other customers will pay $24.15 monthly.
