You’re negotiating a contract and the other party is being difficult. How can you stay calm and in control?
One thing I found effective was to try to relate to the other negotiator on a personal level. I was once in a negotiation when I was the difficult party. My counterpart on the other side wrote on the whiteboard before the start of a second negotiation session, "We are all in this together." This really helped set the tone for future negotiations we set the proper tone for both sides during the negotiation.

What are the best ways to transition between ideas during a presentation?
Always practice your transitions. The rest of your presentation can be free wheeling, but usually if you have your transitions down pat, it focuses you on what you need to say in the next segment. Also, I usually incorporate humor during my transitions. I do this for two reasons: first, I helps me remember them and second, it breaks up the potential monotony of a structured presentation. I have, in presentations, mimicked late night kitchen ware commercials. "But wait, there is more . . " usually gets a chuckle or a grin from audience members who remember those commercials.

What is your process for verifying contract negotiation outcomes?
I also find it useful to work with the other side's negotiator for one final read through of at least the differences between the final document and the first draft. Before that happens, I make sure the changes are consistent with the parts of the contract that have not been edited. When both sides want to work together to minimize the chance that the contract will be litigated someday, the result is usually superior than where there is no such willingness to work together.

What is your process for verifying contract negotiation outcomes?
As a contract negotiator for established companies, this step is a given. The biggest hurdle that the negotiator faces at this stage is learning new systems for contract management when there is a migration to a new system or a substantial upgrade to an existing system. Many companies take this task out of the hands of the lawyer or non-lawyer contract negotiator and puts it in the hands of a skilled legal assistant or paralegal. In those companies, however, those who were involved in the negotiation process as well as those involved in dispute resolution should make sure they can access the contract through the systems and databases the companies have to track their contracts. Simply throwing it over the wall isn't an option!
