I’m interested in how AI is impacting law practice. The U.S. Patent and Trademark Office has issued guidance on how to determine inventorship when AI was involved in creating the invention. In 2022, in Thaler v. Vidal, the Federal Circuit held that “only a natural person can be an inventor, so AI cannot be.”  So, how can something developed by AI be patented? ·      The guidance reaffirms the Federal Circuit decision: Named inventors must be “natural persons.” A non-human, such an AI system, cannot be listed as inventor, even if it was “instrumental” in creating the invention. ·      A person named as inventor must make a “significant contribution” to any AI-assisted invention. ·      This is determined by existing inventorship law: The inventor must contribute in some significant way to the invention’s conception or reduction to practice. ·      USPTO gives an example: A person who merely 1) recognizes the need for a new design to solve a specific problem, 2) prompts an AI system to create a design, and 3) reviews the design outputted by the AI system, has not made a significant contribution. ·      On the other hand, a significant contribution “could be shown by the way the person constructs the prompt in view of a specific problem to elicit a particular solution from the AI system.” ·      These distinctions could be difficult to make in practice. It will be interesting to see how this plays out in real world examples as AI develops and its use in creating inventions increases. ·      The USPTO guidance tells us that inventors using AI should be prepared to demonstrate, with supporting documentation, the specific things they did to contribute to the invention and how AI was used to assist. https://lnkd.in/g6gx_eTV #artificialintelligence #technology #AI

The Department of Commerce’s Bureau of Industry and Security published an interim final rule to expand, correct, and clarify the two interim final rules published on October 25, 2023 with respect to semiconductor manufacturing items, advanced computing items, and supercomputer and semiconductor end use. The rule, among other changes, revises License Exception NAC into two separate license exceptions, clarifies that the NAC notification requirement applies to any destination when the entity-or its ultimate parent-is headquartered in Country Group D:5; identifies additional technical details to be included in NAC notifications; adds Extreme Ultraviolet lithography masks under ECCN 3B001.j and 3B991.b.2 to end-use scopes in 744.23 and 744.6; restores National Security controls to a number of ECCNs caught under .z subparagraphs; and clarifies public comments topics from the October 25, 2023 interim final rules. Comments on the new interim final rule will be accepted until April 29, 2024.

On May 8, I had the pleasure of attending two excellent events: Wachtell, Lipton, Rosen & Katz Silicon Valley Seminar and IP Counsel Café Annual Silicon Valley Meeting.  Among the topics addressed in the sessions I attended were: ·      Strategies for navigating regulatory reviews of M&A. ·      Recent Delaware Chancery Court decisions on director fiduciary duties and oversight. ·      How regulators in US and EU are approaching AI and crypto. ·      Strategies for responding to whistleblower complaints. ·      Protecting trade secrets and addressing confidentiality, privacy, and IP concerns with AI. In an interesting move, Samsung isn’t waiting around for Oura to file any patent claims over its forthcoming smart ring (expected to hit the shelves August 2024). Instead, it’s preemptively filed its own suit against Oura, seeking a “declaratory judgment” that states the Galaxy Ring doesn’t infringe on five Oura patents. The suit alleges that Oura has a pattern of filing patent suits against competitors based on “features common to virtually all smart rings.” The case lists instances in which Oura sued rivals like Ultrahuman, Circular, and RingConn, sometimes before they even entered the US market. https://lnkd.in/gpNi2iCi #startups #patents #ipstrategy #intellectualproperty
