On August 9, 2005, the Delaware Court of Chancery handed down its decision, later affirmed by the Delaware Supreme Court, in In re The Walt Disney Company Derivative Litigation. The court decided in favor of the defendants, members of the Disney board of directors, with Richards Layton attorneys Jesse Finkelstein, Gregory Williams, Anne Foster, and Lisa Schmidt playing key roles in the litigation. Greg Williams described the Disney trial as a “once in a career opportunity for Delaware litigators.” The case grabbed the attention of both the legal community and the entertainment world. It was one of the first trials to be broadcast in its entirety over the internet. Litigation Attorney Focused on Chancery, Intellectual Property (IP), Commercial Insurance, & Complex Commercial Litigation Division (CCLD) Cases in the Delaware Superior Court
On July 18, the Delaware Court of Chancery refused to issue a preliminary injunction in a case involving a covenant not to compete. The court analyzed the covenant and concluded that the plaintiff “failed to demonstrate a reasonable likelihood of success that it will be able to prove at trial that the Non-Compete is enforceable.” A link to the court’s opinion is below. It was a pleasure working with fellow Richards, Layton & Finger attorneys Steve Fineman, Alexandra Ewing, and Morgan Harrison to achieve this successful result for our client.
