Pleased to be the guest on AIMA - The Alternative Investment Management Association's podcast, The Long-Short, "How a humble fish has changed the face of US lawmaking" discussing how the Supreme Court's Loper ruling overturning Chevron deference will change (but not end) SEC rule making and litigation. A big thanks to Tom Kehoe, and Drew Nicol for having me on the podcast.

When faced with regulatory complexity, we can throw up our hands, or roll up our sleeves. Etan Butler of Dalmore Group is definitely a roll-up-his-sleeves type. Hear Etan's latest thinking on the latest Capital Ideas interview with Dara Albright and me from Crowdfund Insider. https://lnkd.in/gkZ33b2r

A big thanks to Brent Baker, and his team at Buchalter for their excellent legal work ensuring that the 10th Circuit won't be deprived of Senator Pat Toomey's important perspective about legislation he principally authored.
Federal Reserve's lengthy delay and lack of transparency in denying Custodia Bank's Master Account Application have raised concerns. Custodia, with a special purpose/Crypto banking charter in Wyoming, faced significant hurdles in this process but had the fortitude to fight back. This fact pattern feels a bit like the U.S. Financial Regulators are determined to stop participants all in the Blockchain space by any means necessary! In a crucial move, Nick Morgan and Investor Choice Advocates Network submitted an amicus brief in support of Custodia Bank against the Federal Reserve entities. Former Senator Pat Toomey played a pivotal role due to his involvement in relevant legislation. I am honored to have worked with Nick and Former Senator Toomey, and Brent Baker, SEC Enforcement/Government Investigations and Buchalter collaborated on this significant legal document. This Senator Patrick Toomey amicus brief, is supported by separate Amici filed by various entities including the Wyoming Secretary of State, U.S. Senate Banking Committee, and Blockchain Association. All challenge the Federal Reserve's denial impacting cryptocurrency deposits. This legal action underscores the importance of transparency and fair practices in financial regulations. #FederalReserve #CustodiaBank #CryptoBanking #Transparency #FinancialRegulations #LegalAction

There's more than one way to break down a barrier to entry to the capital markets. If you make less than $200k or have a net worth less than $1 million, the SEC's "accredited investor" definition hinders your access to private investments. But we were excited to hear about Jonathan C. Dunsmoor's plan to mint legions of new accredited investors through Series 65 on the latest Capital Ideas on Crowdfund Insider with Dara Albright.

Please reach out if you're aware of someone caught up in the SEC's effort to expand the definition of "dealer."
Can an investor with no customers be a securities dealer (with the regulatory requirements such a designation triggers)? The SEC and the 11th Circuit say "yes." Hear from Marc Indeglia of the Small Public Company Coalition as he explains how the 11th Circuit went wrong and the possible negative implications from efforts to expand the definition of "dealer" on the latest SEC Roundup with Thomas Zaccaro by Investor Choice Advocates Network on ThinkAdvisor. Circuit split anyone?

Art Zwickel and Gail Bernstein correctly predicted today's result from the 5th Circuit: the SEC's Private Fund Adviser rules have been vacated. Investor Choice Advocates Network was pleased to have submitted an amicus brief urging this outcome.

Great piece by Matt Levine. I only wish he had read the amicus brief in Panuwat by Investor Choice Advocates Network (https://lnkd.in/gEZ2_qXT), which makes many of the same points. Stephen A. Cazares
