The Center for Health Law and Policy Innovation of Harvard Law School (CHLPI) advocates for legal, regulatory, and policy reforms to improve the health of marginalized populations, with a focus on the needs of low-income people living with chronic illnesses and disabilities. CHLPI works with consumers, advocates, community-based organizations, health and social services professionals, food providers and producers, government officials, and others to expand access to high-quality health care and nutritious, affordable food; to reduce health disparities; to develop community advocacy capacity; and to promote more equitable and effective health care and food systems. CHLPI is a clinical teaching program of Harvard Law School and mentors students to become skilled, innovative, and thoughtful practitioners as well as leaders in health, public health, and food law and policy.

The U.S. Department of Health and Human Services (HHS) issued a new rule to strengthen HIPAA privacy protections for reproductive health care. In this JAMA Viewpoint piece, HLPC Faculty Director Carmel Shachar writes that this new rule is significant because: 1) It closes a loophole: Previously, law enforcement could access abortion records in abortion-restrictive states. 2) It protects people traveling for abortions: Patients who travel to states with legal abortion can now keep their medical records private. 3) It creates challenges for telehealth abortions: Unclear laws make it difficult to determine if telehealth abortions are protected. 4) Clinicians decide lawfulness: Clinicians, not law enforcement, determine if an abortion was lawful under medical necessity exceptions. 5) Legal challenges are expected: States may challenge the rule in court. The Supreme Court last week weighed in on access to abortion care in emergencies. Here's the breakdown: The Cases: Two cases, Moyle vs. United States and Idaho vs. United States, looked at whether federal law allows emergency abortions despite state bans. The Decision: In a 6-3 vote, SCOTUS dismissed the cases, allowing emergency abortions in Idaho for now. What This Means: Idaho can't enforce its abortion ban in emergency situations, but bigger questions remain unanswered. What's Next?
