The Florida Justice Association (FJA), formerly the Academy of Florida Trial Lawyers (AFTL), is dedicated to strengthening and upholding Florida's civil justice system and protecting the rights of Florida's citizens and consumers. FJA works in the legislative, political and public arenas to ensure that Floridians know and understand the importance of their rights to justice and to make certain that these rights, which are at the very core of what it means to be American, are safeguarded and protected.

    WHAT TRIAL LAWYERS DO MATTERS--FOR YOU, FOR SOCIETY, FOR OUR COMMUNITIES. With the Wall Street Journal running another nonsense article on "nuclear verdicts" and Chubb and the Chamber pushing hard for more tort reform, it is important to remind everyone that your life, car, home, food, consumer products, air, water, etc are all safer due to lawyers working to preserve the right to trial by jury enshrined in our constitution. Insurance companies and corporations are not affected by tragedy that affects families, friends, neighbors and communities for decades from one single incidence of corporate negligence and putting profits over people. They see it as a line item, a "loss", and the cost of doing business. On this day, 26 years ago, my sister passed in a car crash. An 89 year old driver pulled out in front of the car she was in and she was in a bad crash. Everyone in the car survived with only minor injuries, but my sister was injured largely from a seatbelt design later removed from production due to the number of deaths and injuries caused by it. My family was represented by an attorney, a very young attorney at the time. My family was one of many that sued the car manufacturer for this defect. One family in a long line of families forever affected by a defective seatbelt. One family that, by itself, would likely have not been a blip on that manufacturers radar but as part of a large group affected change. Would car makers change their designs that kill and injure people without lawsuits? The answer is "no." But, in our system, families can take their disputes to jurors of their neighbors and hold multi-billion dollar companies accountable--to speak in the only language that matters to big insurance companies and corporations. I guarantee that nobody in the C-Suite of any corporate boardroom or insurance company ever knew my sister's name. They never thought twice about the tragedy that never leaves those affected. But, for my family, our friends, our community, she is remembered and mourned. This is the first year I really recognized that she was a kid. She was my big sister but this was the first time looking at her picture I appreciated she was still just a kid. For my trial lawyer brothers and sisters, don't let the bullshit discourage you. And, for those that see loss and death as a line on a spreadsheet, acquaint yourself with at least a few of those affected. #triallawyers #7a #sanantoniotrialawyers

The article discusses the significant financial risks of long-term care (LTC) for Americans, the increasing reliance on Medicaid, and the rise and subsequent struggles of the private LTC insurance industry, which has faced profitability issues and resorted to denying claims and pursuing policyholders for fraud. "Paying for long-term care (“LTC”) continues to be one of the great financial risks facing Americans during retirement. Current estimates suggest that the annual costs of care in a nursing home are roughly $100,000 and that home health care can cost upward of $50,000 per year."
