Municipal authorities and other public entities in Pennsylvania have long been familiar with the weight and burden of DEP and EPA mandates and regulations. Whether it involves issues with stormwater infiltration, erosion and sediment control, or any number of issues related to water treatment, all too often authorities must correct issues that they did not cause. To avoid luxurious lolling by local governments, the Legislature included mandatory deadlines in the Pennsylvania Municipalities Planning Code, which governs municipal regulation of zoning, subdivision and land development within the commonwealth. AI euphoria is now closely followed by AI laws. This month, Colorado introduced the nation’s first AI consumer protection law creating a complex compliance regime for companies that develop or use what’s being called high-risk AI systems. The law is intended to press companies to develop and deploy systems that make automated decisions – in applications for jobs, mortgages, credit, insurance, and other “high-risk” matters – without unintentionally discriminating against people. The law gives companies two years to put in place a compliance process before it takes effect in early 2026. In terms of compliance, the bill directs AI technology developers to conduct impact assessments designed to cover the data that goes into the algorithm and the decisions that come out of the application, the metrics used to assess performance, and a description of how the company is transparent. For users of the tools, the law requires mainly disclosure. Users must be informed that they're interacting with an AI system, how it's being used, and be given the option to opt out. The new Colorado AI regulation could be a tipping point. This groundbreaking law may prompt a wave of similar legislation across the country. Meanwhile, questions remain about federal efforts to establish guidelines for governing AI development and ensuring its ethical and responsible use.
