Waco man arrested following fatal Friday afternoon shooting

WACO, Texas (KWTX) - A Waco man who was shot in the head Friday afternoon during an altercation on Summer Avenue died from his injuries Sunday night.

Waco police reported Tony Alexander, 46, died after being shot in the head at his home in the 2500 block of Summer Avenue.

Nathan Edward Smith, 31, of Waco, remains in the McLennan County Jail under $350,000 bond after Waco police charged him with aggravated assault in the shooting.

Police say the investigation is ongoing and that additional charges are forthcoming against Smith.

According to an arrest affidavit, police found Alexander critically injured after an apparent gunfight inside the Summer Avenue home.

Waco police followed a blood trail going away from Alexander to the back door, where they found blood on the door handle. A neighborhood witness told police he saw two men pull up to the house “aggressively via the alley and back yard driveway,” the affidavit states.

The witness heard gunshots and he saw the two men leaving in a hurry, the affidavit alleges.

“The suspects pulled around to the front of the house and a short time later the same two males appeared walking around the side of the house where they were ripping down the surveillance cameras,” according to the affidavit.

Police are trying to recover footage from the surveillance system as the investigation continues.

Crime scene investigators found five spent 9 mm Winchester casings near where Alexander’s body was found.

As officers were poring over the crime scene, Smith went to Baylor Scott & White Hillcrest Medical Center for treatment of an apparent gunshot wound to his left hand, the affidavit alleges.

Smith told hospital officials he was sleeping in a vehicle on Summer Avenue when he was attacked and shot. When officers tried to question Smith about the incident, he said he was in a fight and then refused to answer any more questions and requested an attorney.

“(A detective) spoke with Smith directly and he indicated he was invoking his right to remain silent, even though he had not been informed he was arrested and that officers were merely wanting to know more about how he had been injured,” the affidavit states.

A nurse reported Smith told her he had been shot in the hand at a house on Summer. Police who searched Smith’s 2015 Chevrolet Tahoe at the hospital found a Glock 9 mm pistol in the driver’s seat that was loaded with Winchester ammunition, the affidavit alleges.

This is the ninth homicide in Waco this year.
