Man charged in assault of elderly woman who kicked him out of her home

WACO, Texas (KWTX) - Kristian Wayne Foster is charged with reckless injury to an elderly person after he kicked in a door that struck his ex-girlfriend’s grandmother in the face, an arrest warrant affidavit states.

The attacked happened on Sept. 24, 2023 but was not reported by the victims until May 26, 2024, the affidavit states.

The elderly woman told police officers Foster was her granddaughter’s boyfriend at the time and he was living with them at her home in the 1000 block of Rambler Dr.

According to the elderly woman, Foster was being very disrespectful and not abiding by the rules in her home. The woman kicked Foster out and told him he was no longer welcome to live with them. Foster gathered his belongings and left through the front door.

As the elderly woman was about to lock the door shut, Foster ran back and kicked the door open, the affidavit states.

The door then struck the elderly woman in the face, causing a large knot on her forehead, lacerations on her nose, two swollen and bruised eyes, and what appeared to be a broken nose, the affidavit states.

When detectives spoke with Foster, he “did say that he pushed the door open and that it hit (the victim) in the face,” the affidavit states.

Foster, however, claimed he kicked the door open because it had “shut on his toe and he did it to free himself,” police wrote in the affidavit.

Detectives spoke with Foster’s ex-girlfriend, the victim’s granddaughter, and she accused Foster of lying, saying she witnessed Foster leave her home, walk on the sidewalk, then run back in the direction of the door to kick it open.

Foster was arrested on June 19, 2024. He is no longer listed as an inmate at the McLennan County Jail.
