IBM classes tech workers in Brazil as sales? This is a new low even for tech companies setting up contracting tech workers. ----- RestOfWorld: "Why IBM employees in Brazil are suing to be classified as tech workers. Unions in two Brazilian states are suing IBM in an effort to be recognized as tech employees, giving them access to better wages, benefits, and profit participation." (LAÍS MARTINS) (APRIL 24, 2024) "--IBM is registered as a sales company in Brazil, making its employees ineligible for benefits granted to tech workers. --Workers in the state of Minas Gerais won a lawsuit against the company to be recognized as IT employees. --Galvanized by the successful lawsuit, workers in another state are following suit, opening the possibility for a flood of legal action against IBM. Galvanized by the win in Minas Gerais, a string of unions in Brazilian states have filed lawsuits against IBM — a technology giant that generated $61.9 billion in revenue last year, with around 427,000 employees worldwide. The lawsuits call for the company to recognize its employees as tech workers, and give them the perks associated with this role. Sales workers, which is how IBM currently categorizes its employees in Brazil, are ineligible for these benefits. In 2021, an IT union in the southern state of Paraná launched a suit against IBM on the same grounds — if judges rule in its favor, the tech workers’ union in São Paulo plans to relaunch its own legal battle, Antonio Neto, president of the IT workers’ union of São Paulo, told Rest of World. “IBM is purely IT. In fact, it’s hard to find a company that is as IT as IBM is,” Leandro Ghizini Smargiassi, a lawyer for the Minas Gerais union who led the lawsuit, told Rest of World. IBM’s refusal to register as such, he said, “is an insult to labor laws.” In Brazil, the work conditions for tech workers are different from those for sales employees. For instance, sales workers have a 44-hour workweek — four hours more than the limit for tech workers. The latter are also entitled to a higher minimum wage, overtime pay, and profit participation — a year-end bonus that depends on the company’s annual profit. In court, the Minas Gerais union argued that IBM is not a sales company and that its main activity is software development. To prove its point, the union underscored the fact that IBM is a member of the Brazilian Association for Information Technology and Communication Companies (Brasscom). 📺 Started my day with an exciting appearance on Bloomberg News where AI was the topic of the day, and we discussed findings from Lenovo's Global CIO Study 2024. Key insights reveal: 🚀 An astounding 80% of CIOs are optimistic about AI’s potential, believing it will have a very significant impact on their business. ⚡️ Echoing this optimism, an overwhelming 96% are gearing up for increased AI investments over the next year. They are not only looking to capitalize on AI's potential but also preparing to integrate these advanced technologies into their strategic initiatives. 🚧 Yet, the journey towards AI adoption isn't without its challenges. CIOs report that the speed of AI implementation is a major barrier, and 61% face difficulties in demonstrating the ROI of their tech investments. These hurdles highlight the complexity of integrating and capitalizing on AI within existing systems. 🤖 Further complicating the landscape, over half feel their technical skills are not fully prepared for the AI era. What a busy week at #DellTechnologiesWorld, meeting with existing and potential customers and partners, listening to great keynotes, and thinking about future innovations. Let me know what you think of my observations: - #Innovation is like a Venturi effect: it's accelerating and will keep getting faster and faster, so buckle up and get on board now! - #AI, and more specifically #LLM (Large Language Model) and #RAG (Retrieval-Augmented Generation) models, is becoming more and more accessible. I was pleased to see many solution drafts making #data more accessible to the end user. The #next challenge to solve will be the limited bandwidth between humans and machines. - Last year, 90% of the data was created inside a data center. The ratio is getting inverted, and by 2027 it is foreseen that 62% of the data will then be generated at the #edge. - Companies need to embark quickly on the #AI journey, and they will require #edge to deploy it successfully. The #vision for the company needs to come from leadership and be executed top-down. "We will eventually get there" is a great loss strategy. - Plan your business #strategy for 2 years, not 5 years anymore. Compare what the #technology available today was able to do 2 years ago, or last year, and put in place innovation projects to use it like it will be in 2 years. A good way to stay #competitive: imagine the company that will become your competitor, plan and execute to become this company. - Dell Technologies announced the new PowerEdge XE9680, an #AI powerhouse for the #edge. Up to 112 CPU cores and 8x H100 80GB GPUs. This is great for training and inferencing on models on-site, ensuring #data #sovereignty. - The development of end-user computers capable of #neural #processing is democratizing the use of applied personalized large #AI models. Forget a personal assistant: #AI is finally becoming the personal accelerator I've dreamed about. - Dell #NativeEdge continues to evolve and can now benefit from the XE9680. Add Atos #SmartEdge and #SovereignAI to the mix and the world has now all the pieces of the puzzle, hardware, management, and AI platform to create #business outcomes while respecting data privacy for the enterprise.
