I’d go as far as saying that document automation is a catalyst for accelerated learning. For junior lawyers, and those transitioning from different legal areas (me) alike. My family law litigation background provided a steep learning curve back when I ventured into commercial contracting at Radiant Law, where doc automation is deeply ingrained in our workflows. Guided prompts and instant feedback transformed the process from a daunting task into a structured learning experience. I could grasp complex legal concepts quicker by seeing their practical application within the document. While doc automation doesn't replace the importance of legal fundamentals, it certainly is transforming and improving how we learn. We're moving beyond the whole 'more time spent = more intellectual yield' myth.

"But how will our junior lawyers learn?" I get this question a lot. The concern is that by using document automation to draft a document, less experienced lawyers will not learn the art of drafting as they are not "cutting their teeth" by manually filling in square bracket after square bracket, page by page. My answer is that Document Automation improves just-in-time learning and can be a training aid. How? 🌟 By inserting guidance next to a question a lawyer can learn the relevance of considering a certain point at the time they are working on that deal. This is a much better way to learn than by a group training session months before they need that knowledge. 🌟 Guidance next to a question is more likely to be read than a footnote. 🌟 A document automation questionnaire acts as a mental checklist for the lawyer of all the points they should consider when drafting that type of document. 🌟 Having a preview screen that shows the changes made to the entire document as they answer certain questions, helps them understand the whole impact of their choice. Over the last 10 years we have taken feedback from lawyers on this point and their use of document automation. If you are facing this argument from your leadership and need help preparing a proposal as to how document automation could benefit your lawyers, please get in touch. #DocumentAutomation 📸 Element5 Digital on Unsplash

There's this idea floating around that legal teams should stick to the legal nitty-gritty and let others handle the rest. We disagree! For example, there's no such thing as a legal (as opposed to a commercial) point. If a so-called "legal" point can't be explained in terms that actually matter for business, then why are we even debating it? Negotiations often get bogged down in these legal nitpicks, while the real problems, like understanding what's being bought or sold, get swept under the rug. Legal teams aren't just missing the boat; sometimes they're not even on the dock when it comes to leading the whole contracting process. Imagine if legal took charge, ensuring every step of the contracting process flowed seamlessly. But how often does that happen? Rarely. Legal needs to get its own house in order first. Then, map out the entire contracting process from start to finish, involving stakeholders and everyone who is part of the process. Find out what they need, what's missing, and get to work fixing it. The danger is an alternative where legal is just another minor stakeholder in the contracting process. https://lnkd.in/dcM9ZHAN #LawyersofLinkedIn #ALSP #Contracts

Unreasonable contracts can kill deals. When writing my book, I received a contract with terms that were just too harsh. I tried to negotiate, but they wouldn't budge. So, I turned to Amazon and published it myself. One unreasonable term can end a deal before it starts. #PublishingProblems #DealBreakers #ReasonableRequests #ClauseAndEffect

Shifting the focus from getting everything you can think of to what both parties need can be uncomfortable, but it's foundational to creating a great relationship, and it's the relationship that creates the value. Going further, both sides need to make a profit - and this is just as true when you have high leverage as when you are on the back foot. #ContractsWithBenefits  #EveryoneGetsACar

I've regularly talked about how legal is part of the marketing department, but it is also part of delivering the broader organisational strategy. It's remarkable how many objectives contracting will impact (and also how often the overlap is ignored). The classic example is growth - there are not many companies that don't have a growth objective, yet sales terms are so often risk-averse and slow to close. #TheRiskisSlowSales #DepartmentOfItsFine

I have concerns about relying on GenAI for drafting - there is real value in consistency across your portfolio of contracts and humans are not great at checking walls of text outputted by a random word generator. Although there's lots of enthusiasm for GenAI drafting, it's mainly amongst those who are not (a) conversant with document automation, and/or (b) who equate legal looking text with correct text. Document automation is one of the biggest force multipliers you can implement. We are big fans of Docassemble, which is both free and as powerful as any commercial system, but there are lots of options out there. I describe document automation as 20 years old in the video, but it's more like 40 years. #DeterminismOverRandom #StitchInTime #OldSchool
