Yesterday, our Senior Partner, Murali Pany, and Partner, Kay Yong, hosted a joint seminar with Jason Nangle, Managing Director and Founder of Angle Recruitment, Maritime Talent Experts to share their views on Changing Employment Trends in the Maritime and Renewables Industries & Restraint of Trade Clauses in Employment Contracts, where the speakers provided their perspectives on a mix of practical employment related matters. Jason Nangle discussed a range of issues and hot topics commonly talked about in the recruitment space, including evolving maritime trends, his observations surrounding employers’ and employee’s views on flexible work arrangements following from the Covid-19 pandemic, and changing norms to employment contracts. Murali Pany and Kay Yong shed light on the judicial approach that the Singapore courts have taken toward the enforceability of restraint of trade clauses, including through the study of the recent high profile cases of Shopee Singapore Ptd Ltd v Lim Teck Yong [2024] SGH 29 and MoneySmart Singapore Pte Ltd v Artem Musienko [2024] SGHC 94 released just earlier this year, and ended off with takeaways for employers to note. This culminated in a relaxing lunch at the Clubhouse where everyone gathered and indulged in some casual indoor golf (with a prize no less for the golfer with the furthest drive!). In a whirlwind of regulations sparked by the Covid-19 pandemic, a tenant allegedly fails to pay rent under an oral tenancy agreement. What protection under the COVID-19 (Temporary Measures) Act 2020 (Act 14 of 2020) (“COVID-19 Act”) is available and what are the landlord’s rights? In Na Bon Tiam v Ark Engineering & Offshore Pte Ltd [2024] SGMC 12, the Court examined a tenant’s eligibility for rental relief, the effect of the moratorium on enforcement action of rent under the Covid-19 Act and whether a landlord is able to exercise a lien over a tenant’s goods. Every contract requires parties to provide something of value to each other. When there is a total failure of consideration, where either party does not provide the value promised, restitution may be granted if it does not undermine parties’ intended allocation of risk. In Lim Chee Seng v Phang Yew Kiat [2024] SGHC 100, only certain benefits were provided by the Defendant under contract. The High Court examined when a total failure of consideration claim can be successfully made out. The team comprising Hariz Lee and Sonia Elizabeth Rajendra acted for the Appellant in this case.
