On 26 May 2023, the Arbitration and Conciliation Act, Cap A18 (ACA), Laws of the Federation of Nigeria, 2004 was replaced by the Arbitration and Mediation Act, 2023 (AMA), which was signed into law on that date by the former President Muhammadu Buhari. On the 7th day of June 2024, the Chief Judge of the Federal High Court of Nigeria, Honourable Justice John Tsoho issued a Practice Direction which will allows litigants to depose to affidavits electronically at the Federal High Court. The Practice Direction known as the Federal High Court (Practice Direction on E-Affidavit), 2024 (“Practice Direction”) came into effect on 1 July 2024. The Practice Direction was issued by the Chief Judge pursuant to Orders 57 and 58 of the Federal High Court (Civil Procedure) Rules 2019 enabling him in that regard. In this article, we examine the objectives of the new Practice Directions, the procedure for obtaining the e-affidavit as well as the prospective benefits and challenges of the new system.
