CDM has emerged over the past four years as a powerful agent of change for migrant rights on both sides of the border.

A few weeks ago, 17 State Attorneys General, growers and big-time farmers filed a suit against the U.S. Department of Labor to stop the new farmworker protection rule from going into effect. We cannot let this happen. Today, we filed a motion to intervene in the lawsuit to ensure that our organization and migrant agricultural workers have a seat at the table as the court decides the future of the rule. We are seeking to enter the suit in two different roles: as an organizational defendant-intervenor and also as counsel for Candelario and Jorge, two migrant H-2A farmworkers who are speaking out in defense of the new farmworker protections. We’re proud to co counsel with and be represented by Adam Pulver of Public Citizen and grateful to Daniel Werner of Radford Scott LLP, who serves as local counsel. By intervening we are fighting to ensure that workers can welcome organizations like ours in their employer-provided housing without fear of retaliation. We are fighting for seatbelts and safe transportation and for all protections against recruitment fraud, retaliation and trafficking included in the H-2A rule. Both Candelario and Jorge faced retaliation for standing up for themselves and their coworkers to demand better working conditions –self-organizing activities that would be protected under the new rule. They too are fighting to ensure that they and other workers are better protected in future H-2A employment and can demand better working conditions. Stronger farmworker protections are necessary and long-overdue. We’re determined to see the new farmworker protections implemented as soon as possible. And we are committed to ensuring migrant worker voices are front and center during the upcoming proceedings. If our motion to intervene is granted, we will be in a great position to do so. “M” was working as an H-2A worker in the fields of North Carolina picking sweet potatoes when a fellow worker died due to heat stress. Today he celebrates the proposal for a federal heat safety standard that will protect millions of workers. “Working in incredibly hot weather for 8, 10, even 12 hours a day is complicated. We often can’t hydrate or have breaks. This heat protection rule is a good thing... I’m glad that we will feel more protected. We deserved this." CDM celebrates with "M" the Biden Administration’s proposal for a federal heat safety standard that has the potential to protect millions of workers from excessive heat in their workplaces, especially agricultural workers who spend hours upon hours working under an unrelenting sun. 2023 was the hottest year on record. Heat associated deaths also broke records last year. And 2024 might surpass the previous year on both counts. A federal heat protection standard is needed now more than ever.
Today, President Biden announced several actions to address extreme heat, including an upcoming OSHA proposed rule to establish the first-ever federal safety standard addressing excessive heat in the workplace. The proposed rule includes requirements for: 💠 Identifying heat hazards 💠 Developing heat illness and emergency response plans 💠 Providing training to employees and supervisors 💠 Implementing work practice standards — including rest breaks, access to shade and water, and heat acclimatization for new employees. OSHA projects the rule would affect approximately 36 million workers and substantially reduce heat injuries, illnesses and deaths in the workplace. Read more: https://lnkd.in/eRQMpXfv

Rosa Linda was thrilled to receive an offer to work an engineering job in the US. She thought it'd be a great opportunity to advance her career. But once in the US, she was put to work doing intense manual labor, carrying heavy auto parts for hours on end. Even after Rosa Linda discovered she was pregnant, her employers at #GFA Alabama and #Hyundai Glovis refused to modify her duties to accommodate her pregnancy. Now, Rosa Linda is seeking justice for herself and for other migrant workers facing the same kind of fraud and abuse. Last week Julia Coburn and Carlos Ricardo Ortiz attended the 2024 Office of Minority Health - U.S. Department of Health and Human Services (HHS) Awardees meeting in St. Louis to talk about our experience with our Language Access project. They shared CDM's partnership and sustainability strategies, as well as the co-creation process through which we created materials focused on educating migrant and immigrant communities about their right to receive information in their own language, especially when it comes to information about their health.
