Terms of Use for Karger Websites


 

Copyright Protection

The content on the Karger Websites – including but not limited to – journal articles and book chapters in whole or in parts, titles, logos, trademarks, graphic designs or adverts are the intellectual property of S. Karger AG or published with permission from the legal copyright owner. All rights are reserved.

Unless otherwise noted, no part of the content on the Karger website may be translated into other languages, reproduced or utilized in any form or by any means, electronic or mechanical, including photocopying, recording, microcopying, or by any information storage and retrieval system, without permission in writing from the publisher.

In particular, it is forbidden to use any of the Karger content available on or through the Karger website for the purposes of training artificially intelligent tools. Karger claims copyright on any result produced by artificially intelligent tools using Karger content, irrespective of the amount of the used content.

Prohibited Uses

No visitor at karger.com may systematically make print or electronic copies of multiple extracts of the website’s content for any purpose other than as explicitly permitted by an individual license. No visitor at karger.com may index and/or systematically download the content of the present website, especially operated by the application of a bot or crawler, for any purpose other than, upon prior request, TDM technologies to derive information from the website.

 

Privacy Policy

Data protection is a particularly high priority for the management of S. Karger AG. The use of the Karger Websites is possible without any indication of personal data; however, if a data subject wants to use special enterprise services via our Websites, processing of personal data could become necessary. If the processing of personal data is necessary and there is no statutory basis for such processing, we generally obtain consent from the data subject.

The processing of personal data, such as the name, address, email address, or telephone number of a data subject, shall always be in line with the Regulation (EU) 2016/679 of The European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation [GDPR]), in accordance with the Swiss Federal Act on Data Protection (FADP) and the Ordinance to the Federal Act on Data Protection.

Cookies

The Karger Websites are using „Cookies“, which means text files that are stored in a computer system via an Internet browser. Through the use of Cookies, S. Karger AG can provide the users of these Websites with more user-friendly services that would not be possible without the cookie setting.

Payment

Karger guarantees that payment by credit card is secure by using standard-procedure SSL or SET and encrypted data. No separate invoice is issued/sent, but the customer will receive a confirmation/receipt message with key details of the transaction. The payment process will be operated by our partners SaferPay or Datatrans. Customer’s credit card data are neither stored, copied or downloaded to Karger servers nor are they passed on to third parties. None of these data will be used for mailings or other promotional activities.

It is mandatory that credit card information is submitted exclusively via the fields provided for this purpose and displayed to the customer as part of the payment process on the website. Karger does not accept transmission of credit card data by email, fax, mail or orally by phone or video call.

All online courses offered in cooperation with Thinkific are payable with voucher codes or PayPal only.

Purchases of online products such as articles, book chapters or online courses cannot be canceled once the transaction has been approved and the confirmation has been sent. Such online items cannot be returned for credit either.

By choosing the Karger Article Bundle (KAB) prepay option the customer will be entitled to purchase a previously determined number of journal articles and/or book chapters within a period of five (5) years after the customer's account has been charged. At the end of the five-year period any remaining credit on the customer's account will expire.

 

Registration and Password

Some sites may require user to register. If registration is required, user shall provide accurate and complete registration information. It is user’s responsibility to inform Karger of any changes to that information. Each registration is for a single individual only, unless specifically designated otherwise on the registration page.

When using a password to access, the user must not reveal their password and must take reasonable steps to keep the password confidential and secure. The user shall immediately notify Karger if becoming aware of – or have reason to believe that there is – any unauthorized use of their password or account or any other breach of security. Karger shall in no way be liable for any claims or losses related to the use or misuse of the password or account due to the activities of any third party outside of our control or due to user’s failure to maintain their confidentiality and security.

 

Additional Terms

Additional or superseding terms and conditions may apply to purchases or supply of goods or services and to subscriptions or licenses with institutions with which user may be employed or affiliated. If there is a conflict between these Terms of Use and the terms that are posted for or applicable to a specific portion of the Service, for any service offered on or through the Service, or set forth in an institutional subscription or license agreement, the latter terms shall apply.

Service Access

While Karger endeavors to ensure that the Karger Websites are normally available 24 hours a day, Karger shall not be liable if for any reason the Karger Websites are unavailable at any time for any period.

Access to the Karger Websites may be suspended temporarily and without notice in the case of a system failure, maintenance or repair for reasons beyond Karger's control.

Access to products on the Karger Websites may be made upon the condition of registration. To stay up to date and deliver services of the highest standards, and to be compliant with privacy laws, from time to time, customers who bought Karger products which are only available through the Karger Websites, may be asked to re-confirm their credentials, including personal data, or to adjust their registration credentials. In case a customer does not follow up with Karger after having been duly informed about any changes to their registration process, they might not be able to log into the Karger Websites anymore, and therefore risk to lose access to the product which they have bought. Shall this happen to you, we will be glad to assist in clarifying the circumstances, and give you a new access to the product which you have purchased.

Notwithstanding the foregoing, nothing in this legal notice will preclude Karger from applying to any court to bring an action for the infringement of its intellectual property rights.
