Family of Bianca Devins suing Oneida County DA's Office saying it released video of murder

The family of murder victim Bianca Devins is suing the Oneida County District Attorney's Office over what the lawsuit calls "dissemination of snuff and child pornography of a 17-year-old-victim."

The 22-page lawsuit was filed on Thursday and stems from the case of Bianca Devins' murder in July of 2019. Brandon Clark was sentenced to 25 years to life in May for the murder. Instead of going to trial, he pleaded guilty. Clark posted graphic pictures of her body on social media and called police to the scene of the crime, stabbing himself in the throat when they arrived.

According to the lawsuit, Clark set up a camera in his SUV and filmed himself having sexual relations with Devins before stabbing her to death. Both were recorded.

Devins' mother, Kimberly, says two sets of documentary makers informed her the District Attorney's office had given them the sex and murder videos. According to the lawsuit, two assistant district attorneys had previously promised her mother the videos would never be shared. The lawsuit says to date, Kimberly Devins has not seen the videos of her daughter's last moments on earth and claims the Utica Police Department and Oneida County District Attorney's office told the family they had to make a motion in criminal court to see them.

The lawsuit also alleges the videos were granted through a Freedom of Information Law request to Alissa Tallman, a YouTuber. It claims the contents of Bianca's phone including nude images of Bianca were also released, and claims this violates federal child pornography laws.

The lawsuit also named Oneida County, DA Scott McNamara, and John Does 1-20, which are employees or agents of Oneida County and the District Attorney's Office.

CNY Central and its affiliate station in Utica have reached out to the District Attorney's Office for comment.
