📢 ESMA Clarifies Staking Under MiCA! 📢 European Securities and Markets Authority (ESMA) has confirmed that #MiCA does not prohibit #staking. However, staking services (staking-as-a-service) require providers to be authorized for custody and administration of crypto-assets. 🔍 Key Points: - Custody Requirements: Staking services must comply with MiCA’s custody rules, including asset segregation and liability for loss. - Client Consent: Explicit client consent is required when staking is combined with other services. - Liability: Providers are liable for any losses during the staking process. Stay compliant and protect your clients!

Switzerland and the EU issued a joint statement today where they discussed also the regulatory frameworks relating to cross-border activities, including equivalence regimes. Will this be a first step into access to the EU market for financial instutitions? We fear we are still far away from it, but we support any discussion about this important topic.
