LOUISVILLE, Ky. (WAVE) - The three heirs of Jamey Noel’s late brother William are trying to get money back after Indiana State Police said they were shorted.

The heirs learned they were shorted at least $52,000 when ISP charged Noel with theft and released search warrants detailing how he sold their father’s home to his daughter, gifting her the $36,000 down payment. Now they’re trying to get the judge to reopen the estate, to possibly undo that sale.

In addition to selling his brother’s home to his daughter, warrants show Noel mixed New Chapel funds with the estate, profiting from repairs on another house. Noel did not answer a question as he walked from the Madison courtroom to the waiting elevator for deputies to return him to the Scott County Jail.

“The transaction that we are most concerned with was the fraudulent sale where money was gifted to a daughter,” said Amy Wheatley representing William Noel’s heirs.

State police said records showed Jamey Noel sold his late brother’s house to his oldest daughter, Kasey, and covered the $36,000 down payment from the sales price. Noel’s attorney Zach Stewart told the judge the law doesn’t allow the estate to be reopened.

“Nothing else matters relative to the court’s subject matter jurisdiction as it relates to this issue, we just ask that the court deny the petition to reopen,” said Stewart.

The judge expected to issue a ruling by August before Noel is scheduled to be brought in for a deposition. Wheatley said the three heirs are angry.

“This was a terrible time for them, they trusted their uncle to take care of them and he didn’t,” said Wheatley.

Meanwhile, ISP released six more search warrants as they dig deeper into Noel’s spending. The newest findings include $60,000 at Allegiant Airlines, $29,000 on Cincinnati Reds tickets, including $3,700 on four sets of season tickets Noel purchased after his arrest last year.

Jamey Noel’s trial is supposed to start in November. His wife Misty asked last week to delay her trial, which was supposed to start at the end of this month. Kasey’s trial is supposed to start in late August.
