European Court of Human Rights

Saadi v United Kingdom (Application No 13229/03)

A delay of 76 hours in providing reasons for the detention of an asylum seeker was not compatible with article 5.2 of the European Convention on Human Rights that such reasons should be given promptly.

The Grand Chamber of the European Court of Human Rights so held on January 29, 2008, confirming the judgment of a chamber of the Court (The Times August 3, 2006) that there had been a violation of article 5.2 but not of article 5.1.
