A high-profile case for Livingstone Brown in the past year was Whitehouse v Lord Advocate, a case that changed the legal landscape. Its client was prosecuted on fraud charges linked to Rangers FC takeover in 2011 and its subsequent administration. With the firm’s assistance, all charges were abandoned or dismissed by the court.
The client then raised a malicious prosecution action. The Crown defended the action, claiming that the prosecution had been properly conducted and that it was immune from suit. On appeal, the Crown’s immunity was overturned. Livingstone Brown assisted the client in demonstrating that the prosecution lacked probable cause and was malicious, leading the Crown to admit liability and pay damages in excess of £10 million. It is expected that there will be a public inquiry into the events.
