Highlights of the past year include representing the insurer Chubb Bermuda in a Supreme Court dispute with Halliburton, an oil services provider, linked to the alleged bias of an arbitrator in a claim concerning the Deepwater Horizon disaster.

The firm also acted in two of the most significant recent cases in the oil and gas sector, representing Apache UK Investment in two claims before the High Court in London. The first was a dispute over shipping volumes and the second concerned decommissioning obligations related to hydrocarbon fields in the North Sea.

In one of the biggest cases to arise out of the pandemic, Clyde & Co acted for three of the eight insurers in the high-profile test case brought by the City watchdog, the Financial Conduct Authority, over business interruption insurance. The Supreme Court’s ruling meant that tens of thousands of small business will receive payouts for losses caused by the first national lockdown.

Over the past year the firm successfully defended a claim on behalf of the transport operator First Group before the All-Scotland Personal Injury Court. The claim centred on whether a collision between a bus and a van was caused by the negligence of the bus driver or the unexpected occurrence of black ice.

It also represented a Scottish local authority in the defence of 458 holiday pay claims raised under the Working Time Regulations, resulting in all of claims being withdrawn, dismissed or struck out. Clyde & Co also acted for a manufacturer of pelvic mesh products, which was used in operations to repair organ prolapses or treat urinary incontinence and has left women in chronic pain and reliant on wheelchairs.
