UPDATED:

A Pomona man who was shot and injured during an apparent home invasion robbery in Newport Coast in mid-April appeared in court for the first time Monday.

Andrew Miguel Rosas, 24, until recently was recovering from gunshot wounds sustained during the apparent attempted robbery of a home inside a gated community in the pricey, coastal city on Tuesday, April 16.

The homeowner fired at Rosas and another man who entered the house on Vista Luci that morning armed with handguns and carrying zip ties and rope, according to the Newport Beach Police Department. Officials said the other man was found dead in the bushes outside the home from an apparent self-inflicted gunshot wound. He has not been identified.

On Monday, April 29, Rosas pleaded not guilty to one count each of burglary, robbery, conspiracy and carrying a loaded firearm in public, court records showed.

Monday was the first time Rosas was able to appear in court following an extended hospital stay, according to court records. He remains in custody without bail.

Attorneys for Rosas did not immediately return requests for comment.

Police said a man, two women and a child were inside the Vista Luci home when the two apparent robbers got inside — the man confronted the duo and fired at them both, hitting one and sending the other scrambling outside.

A spokesman for Newport Beach police said investigators had learned that the robbery suspects knew the residents at the home. But police have not described how they knew each other.
