Nurture Life takes your privacy seriously. We have created this Privacy Policy to explain how we collect, use, disclose and store the personally identifiable information we receive from you, as well as non-identifying information about you. This Privacy Policy is incorporated in our website Terms, and all capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms.

This Privacy Policy describes:

  • The Personal Information that Nurture Life receives from you when you interact with our Site or subscribe to our Service
  • How Nurture Life uses the Personal Information that it receives
  • If and why Personal Information may be disclosed to third parties
  • Your choices regarding the collection and processing of your Personal Information

By accessing the Services or submitting your personally identifiable information or non-identifying information about you in connection with your use of the Services, you agree to the terms set forth in this Privacy Policy and consent to the collection and processing of your information as described in this Privacy Policy. If you do not agree with any part of this Privacy Policy, do not submit information through the Site.

What We Collect

“Personal Information”

Nurture Life collects Personal Information about you and your family when you voluntarily submit that information to us. “Personal Information” means information that identifies you, that is related to you, that describes you, or is linked with you. This includes your name, address, telephone number, credit card information, email address, shipping address, username, password, dietary preferences and allergens, order preferences and history, children’s ages, if you connect through social media sites, your interests and social connections and IP address. You voluntarily submit that information to us (i) by registering as a subscriber on the Site, (ii) by signing up for our newsletter or Blog, (iii) through the “Contact Us” page, or (iv) by email or telephone. Other information that we may collect from you include your interests and social connections if you connect to us through a social media site.

Cookies

Like many companies, we may store some information on your mobile device or computer hard drive as a “cookie” or similar type of file. “Cookies” are small computer files that a website or its service provider transfers to your computer or mobile device’s hard drive through your web browser (if you allow) that enables the site or service provider’s systems to recognize your browser and to capture and remember certain information, such as a user ID, user settings, browsing history and activities conducted while using the Services. Cookies are not themselves personally identifiable, but may be linked to Personal Information that you provide to us through your interaction with the Services. We use this information to help us enhance the efficiency and usefulness of the Services and to improve customer service. If you object to the use of cookies, you will not be able to use our Site.

Children’s Information

Nurture Life does not intend for children under 16 to use the Site or to submit information—our Site is directed to parents and authorized caregivers. You have the option to provide your children’s names (but you are free to use an alias), ages and dietary preferences if you would like us to provide a more tailored experience to your specific family’s needs, for example, allowing us to suggest appropriate types of meals and portion sizes, and personalized offers and communications. By submitting information about the children in your family, you represent to us that you have the legal right to disclose this information to us for the purposes described in this Privacy Policy.

Usage Data

When you use our Site or subscribe to our Service, we may automatically collect certain non-identifying information about you or “Usage Data,” such as your movement about the Site, the type of browser or operating system you use, the domain name of the website from which you linked to our Site and IP address.

Testimonials

If you send us a testimonial, reviews, compliment, or other positive feedback, we may publish it, but we will only identify you by first name, last initial, photo provided by you, city and state and the ages of the children associated with your account; for example: “Julie K, Chicago IL (kids 3 and 6).”

How We Use Personal Information

Our Uses

We use the Personal Information that we collect to fulfill the orders you place through our Service, to operate, improve and personalize the Services, to provide customer service, to customize our advertising and marketing, to help us develop our new products and services and improve our existing products and services; to detect, prevent and mitigate fraudulent or illegal activities; and to enforce our Site’s Terms or other applicable policies.

Sharing with Third Parties

We may share certain de-identified demographic information with third-party partners to allow them to provide certain kinds of services to us. We and they use this kind of de-identified information for data modeling, marketing and improving our Service.

Additionally, in the event of a merger or an acquisition of our Company by or with a third party, the Personal Information will constitute an asset of our Company which will be transferred to the new owner. It will still be subject to this Privacy Policy unless and until it is amended in accordance with its terms. We will also share your Personal Information if we are required to do so to cooperate with law enforcement, an order of a court, or if we believe, in good faith, that such a disclosure is necessary to comply with the law, defend our rights or property or to respond to an emergency situation.

Where We Store Personal Information

Personal Information gathered through this Site is stored in the United States. If you submit information from a jurisdiction outside the United States, you are responsible for compliance with the laws of your jurisdiction. The Site is not intended for users outside the United States, and Nurture Life does not ship outside the United States.

Do Not Track Signals

At this time, we are not able to respond to web browser “do not track” signals.

Security

We implement a variety of security measures to maintain the safety of your personal information that you submit. All credit card transactions through our Site are carried out using Secure Sockets Layer (SSL) encryption. However, the security of information transmitted through the internet can never be guaranteed. We (like all websites) cannot warrant or guarantee 100% security of any information you transmit to us at our websites. You have the responsibility for keeping your username and password secure. We also recommend that you sign out after each session on the Site and close your browser to avoid unauthorized access to your account.

Linked Sites

We may permit certain third parties to link to our Site, and the Site may contain links to third-party websites. Nurture Life is not responsible for the privacy policies or practices of such third parties, including on such third parties’ websites. When visiting a third-party website, you should read the privacy policy stated on that website.

Your Choices

If you are concerned about the information you have provided to us, or would like to review, update, correct or delete that information, please contact us at (877) 988-8851 or (312) 517-1888.

If you do not wish to receive marketing or promotional materials from us, you may opt-out of receiving future marketing or promotional emails from us by clicking the “unsubscribe” link at the bottom of any marketing email from us and opt-out of receiving future marketing or promotional SMS messages by replying “STOP” in response to any SMS message from us. Please note that it may take up to ten (10) days for that change to register in our system. Notwithstanding such an opt-out, as long as you remain a subscriber to our Service, you will continue to receive transactional emails from us related specifically to the Service we are providing to you.

Your California Privacy Rights

California residents may exercise certain privacy rights pursuant to the California Consumer Privacy Act of 2018. Your right to submit certain requests to us as a California resident are described below. You may designate an authorized agent to make the requests below on your behalf. An authorized agent must submit proof to us that he or she has been authorized by you to act on your behalf, and you will need to verify your identity directly with us.

Verification of Requests

Please note that when submitting a request, you will be asked to provide information to verify your identity or authority to make the request before action is taken.

We will generally try to avoid requesting additional information from you for the purpose of verification, but we may need to do so if we cannot verify your identity based on the information already maintained by us. If we request additional information to verify your identity, it will be for that purpose only, and will be deleted as soon as practical after processing the request, except as otherwise provided by law. Verification is required in order to confirm that the person submitting the request to know or request to delete is the person to whom the information relates, and to prevent unauthorized access or deletion of information. The specific steps taken to verify the identity of the requesting person may vary based on the nature of the request, including the type, sensitivity and value of the information requested, the risk of harm posed by unauthorized access or deletion, the likelihood that fraudulent or malicious actors may seek the information, the robustness of personal information provided to verify your identity, the nature of our business relationship with you, and available technology for verification.

The following generally describes the verification processes we use:

Password Protected Accounts. If you have a password-protected account with us, we may use existing authentication practices to verify your identity, but will require re-authentication before disclosing or deleting data. If we suspect fraudulent or malicious activity relating to your account, we will require further verification (as described below) before complying with a request to know or delete.

Verification for Non-Accountholders. If you do not have, or cannot access, a password-protected account with us, we will generally verify your identity as follows:

For requests to know categories of personal information, we will verify your identity to a reasonable degree of certainty by matching at least two data points provided by you with reliable data points maintained by us.
For requests to know specific pieces of personal information, we will verify your identity to a reasonably high degree of certainty by matching at least three data points provided by you with reliable data points maintained by us. We will also require a declaration, signed under penalty of perjury, that the person requesting the information is the person whose information is the subject of the request or that person’s authorized representative. We will maintain all signed declarations as part of our records.
For requests to delete personal information, we will verify your identity to a reasonable degree or a reasonably high degree of certainty depending on the sensitivity of the personal information and the risk of harm posed by unauthorized deletion. We will act in good faith when determining the appropriate standard to apply.

If there is no reasonable method by which we can verify your identity, we will state so in response to a request to know or delete personal information, including an explanation of why we have no reasonable method to verify your identity.

Right To Request More Information
We generally describe in this privacy policy how we collect, use, and share your personal information. In addition to what is described above, if you are a California resident, you also have the right to request more information regarding the following, to the extent applicable in the past 12 months:
(1) The categories of personal information we have collected about you.
(2) The categories of sources from which we have collected your personal information.
(3) The business or commercial purpose why we collected or, if applicable, sold your personal information.
(4) The categories of third parties with whom we shared your personal information.
(5) The specific pieces of personal information we have collected about you.
(6) The categories of personal information that we have shared with third parties about you for a business purpose.

Please note that due to the different requirements of the applicable laws, our response times may vary depending on the specific type(s) of information sought. We respond to all verifiable requests for information as soon as we reasonably can, and no later than legally required.

In connection with submission of your request, we will take steps to verify your identity as outlined below, and you will need to verify your identity before action is taken.

Right To Request Deletion Of Your Personal Information

You have the right to request that we delete your personal information collected or maintained by us, subject to certain exceptions. Once we receive and verify your request, we will let you know what, if any, personal information we can delete from our records, and we will direct any service providers with whom we shared your personal information to also delete your personal information from their records. There may be circumstances where we cannot delete your personal information or direct service providers to delete your personal information from their records. For example, if we need to: (1) retain your personal information to complete a transaction or provide a good or service; (2) detect security incidents; (3) protect against unlawful activities; (4) identify, debug or repair errors; or (5) comply with a legal obligation. Right to Opt-Out of Our Selling of Personal Information

Right to Non-Discrimination for the Exercise of California Resident’s Privacy Rights

In addition to the rights listed above, by exercising any of the above listed privacy rights conferred by the California Consumer Privacy Act of 2018, you have the right not to receive discriminatory treatment by us. This means that, consistent with California law, we will not deny providing goods or services to you, charge you different prices or provide a different level or quality of goods and services to you unless those differences are related to the value of your information.

Your Nevada Privacy Rights

We do not and will not sell your personal information to third parties. As such, there is no need to submit a request for us not to sell your personal information.

Changes to Our Privacy Policy

The Effective Date of this Privacy Policy is set forth at the top of this Privacy Policy. Nurture Life may modify this Privacy Policy at any time. We will notify you of changes by posting the modified Privacy Policy, and its effective date, on this page. For this reason, you should regularly review this Privacy Policy and note the effective date. If you are already a subscriber, we will notify you the next time you log in to your account following the change. Your continued use of the Services after the Effective Date constitutes your acceptance of the amended Privacy Policy. The amended Privacy Policy supersedes all previous versions.

Biometric Information Privacy Policy 

In accordance with the Illinois Biometric Information Privacy Act 740 ILCS 14/1, et seq. (“BIPA”), Nurture Life (hereinafter the “Company”) has instituted the following policy to define the policy and procedures for the collection, use, safe-guarding, storage, retention, and destruction of employee Biometric Information and Biometric Identifiers collected by the Company and/or its vendor(s) (collectively, the “Company’s Vendors”) :

Definitions

  1. Biometric Identifier: means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry, and may also include an individual’s voice.  Biometric identifiers do not include, amongst other information, writing samples, photographs, tattoo descriptions, or physical descriptions such as weight, hair color or eye color. 
  1. Biometric Information: means any information, regardless of how it is captured, converted, stored, or shared based on an individual’s Biometric Identifier used to identify an individual.
  1. Informed Written Consent: a form executed by an individual, including Nurture Life’s Biometric Clock– Employee Consent and Release Form, authorizing the Company to possess, capture, receive, purchase, use, collect, disclose, redisclose, transmit or otherwise disseminate the individual’s Biometric Identifiers and Biometric Information.

Policy

  1. The Company and/or the Company’s Vendors collect, protect, use, and store Biometric Identifiers and Biometric Information in accordance with the applicable laws including, but not limited to, the BIPA.
  1. An individual’s Biometric Identifier(s) and Biometric Information will not be collected, otherwise obtained, transferred, disclosed or stored by the Company and/or the Company’s Vendors without the prior Informed Written Consent (see Biometric Clock– Employee Consent and Release Form) of the individual.  The individual’s Informed Written Consent will be obtained:
    • At the time of hire and as a condition of employment for employees; or
    • At any other appropriate time that is prior to the Company and/or the Company’s Vendors collecting, otherwise obtaining or storing the individual’s Biometric Identifier(s) or Biometric Information.
  1. The Company will not sell, lease, trade, or otherwise profit from an individual’s Biometric Identifier(s) or Biometric Information. 
  1. The Company and/or the Company’s Vendors will not disclose, redisclose, transmit or otherwise disseminate any Biometric Identifiers or Biometric Information unless:
    • The individual first provides Informed Written Consent to the disclosure, redisclosure, transmission or dissemination by executing the Biometric Clock– Employee Consent and Release Form or another comparable Informed Written Consent form;
    • Disclosure is required by state or federal law;
    • Disclosure is required pursuant to a valid warrant or subpoena
  1. Unless otherwise required by regulation, the Company shall retain and require the Company’s Vendor to retain Biometric Identifiers and Biometric Information only until the first of the following occurs, after which time the individual’s Biometric Information or Biometric Identifiers will be securely and permanently destroyed:
    • The initial purpose for collecting or obtaining such Biometric Identifiers or Biometric Information has been satisfied, such as the termination of the employee’s employment.
    • Within three years of the individual’s last interaction with the Company.
  2. The Company and any party to whom the Company discloses, rediscloses, transmits or otherwise disseminates Biometric Identifiers or Biometric Information, including the Company’s Vendors, will use a reasonable standard of care to store, transmit, protect from disclosure and destroy all Biometric Identifiers and Biometric Information. Such storage, transmission, protection from disclosure and destruction shall be performed in a manner that is the same as or more protective than the manner in which the Company stores, transmits, protects from disclosure and destroys other confidential and sensitive information, including personal information that can be used to uniquely identify an individual or Protected Health Information.
