The U.S. Court of Appeals for the Sixth Circuit held oral arguments on Dec. 8 to determine whether a federal appellate court or a district court was the right venue to hear challenges to the clean water rule, or the waters of the U.S. rule.
The case to decide which court holds jurisdiction has been described as "the mother of all procedure cases" by Hunton & Williams attorney Sam Brown because it digs into congressional intent, case law, and interpretations.
