Procurement Flow-downs Can’t be One-sided! April 19, 2024 The Coalition for Government Procurement "Flow-down requirements are a unique, yet ubiquitous, feature of the federal acquisition system. Flow-down requirements impact prime contractors, subcontractors, customer agencies, contracting activities, and contracting officers. The Federal Acquisition Regulation (FAR) includes a host of contract clauses that must be flowed down to subcontractors. Moreover, given the procurement system’s focus on regulatory and performance compliance, prime contractors are incentivized to flow down as many clauses as possible beyond those mandatory flow-downs. Some of these additional flow-downs can be central to contract performance, like the Trade Agreement Act (TAA). The government expects, in the normal course of business, that prime contractors and subcontractors effectively address flow-down requirements to ensure contract compliance. ...." Public Services and Procurement Canada | Services publics et Approvisionnement Canada (PSPC) - Canadian Surface Combatant (CSC) In-Service Support (ISS) Working Group (CIWG) LOI On April 25th, PSPC released an LOI to assist Canada in developing its requirements for the ISS for the new CSC class of vessels. Canada intends to engage with Industry to obtain relevant advice and recommendations. This advice may be taken into consideration in the development of future solicitation documentation for the competitive procurement of ISS for the CSC. The intent of the LOI is to identify capable and interested respondents to participate as members of a joint, Government of Canada and Industry, CSC ISS Working Group (CIWG). Suppliers will self-attest to their suitability for CIWG membership in accordance with Section 8 of the LOI. The CIWG will assist the Government of Canada in shaping the requirements of future competitive RFP processes and resulting contracts by providing advice, information and recommendations. https://lnkd.in/erNunn3S

Are Middle Tier Acqusiton (MTA), Adaptive Acqusitions Framework (AAF) simply traditional acausition pathways bloat cloaked in new buzz words? Substantial increase in commercial items buying and production contracts is the only way out of our current morass. Becoming just another consumer is how the government leverages commercial investments without the government needing to imagine all its IT requirements. Interesting read of the recent testimony from Bill Greenwalt from the American Enterprise Institute on the “State of the defense acausition system, 2024.” We need to rethink the Competition in Contracting Act dogma of our acquisition system and truly balance it with Federal Acqusition Streamlining Act. True competition happens in commercial industry. Government should find its voice acknowledging what congress has asked them to do this and drastically increase commercial items buying at scale. Can we just cite FASA in the acqusition packets below the SAP thresholds? Fair competition with no commercial suppliers is not the way. I fear that’s where we’re headed as I listen to top Software Vendor after software vendor struggle to close the business case for product investments required for any serious Federal Go-To-Market (GTM) effort that sustains. The government runs one of the worlds largest IT enterprise. FISMA has all the requirements for modern agencies, why not just let industry sell into these vs. competition theather? The later is leading to the shrinking supplier base at the alter of CICA.
