Besides the competition over who can develop the most advanced large language models (LLMs) between the U.S. and China, the U.S. AI ecosystem leads in private investment, which is crucial for fostering innovation and development in the sector. The U.S. also dominates in the number of new AI start-ups compared to China. In contrast, China imposes strict regulations on AI development and usage, mandating that generative AI services reflect Core Values from the content point of view. China's leadership is more pronounced in the industrial robotics sector, highlighting its strategic focus on automating and modernizing its manufacturing industry.

An interesting and valuable report!

World Intellectual Property Organization – WIPO has recently released a report on the patent landscape focussing on #GenAI. Some headlines from the report: Patents on GenAI have grown exponentially in the last 5 years (which alone indicates most of these are likely to be useless). China is a HUGE player in this arena, far outstripping the nearest competitor US. Image and video generation dominate in these patents. GenAI accounts for ONLY 6% of all AI related patents worldwide. All in all, the report promises to be a very interesting read.

Revolutionizing Patent Analytics: The Impact of Generative AI 🧩Generative AI has the potential to revolutionize patent analytics. Instead of relying on predefined patent classes, #GenAI tools can identify areas of development or collect relevant #patents for new concepts directly through #prompts or fine-tuned models. 🧩This approach represents a significant shift in how patent analysis is conducted. We can expect a wave of related patents very soon, especially as the success of #ChatGPT has driven innovation in a wide range of applications. 🧩We can only guess at what is to come by counting the patents from patent offices that publish earlier than 18 months on average, such as China. A future update study should be able to visualize this development, perhaps by using GenAI itself to do the work. The U.S. Patent and Trademark Office (USPTO) has updated its guidance on patent subject matter eligibility to support innovation in critical and emerging technologies, including artificial intelligence (AI). Effective July 17, this update, mandated by President Biden's October 2023 AI executive order, provides clarity on evaluating AI inventions with three new examples illustrating the application of eligibility analysis. These examples address AI-specific limitations, AI-based speech signal analysis, and AI models for personalized medical treatment. USPTO Director Kathi Vidal emphasized the commitment to fostering innovation and encouraged public feedback on this guidance, which will enhance understanding and application of patent eligibility criteria.
