🚨 EU Cracks Down on Eco-Crimes! 🌍 The European Union is getting serious about protecting our planet! Lawmakers just approved stricter penalties across the bloc for environmental offenses. ⚖️ But here's the question: Will harsher punishments really deter those who harm our environment? 🤔 Or do we need a more comprehensive approach? 🤝 Some argue that stricter laws are the way to go, while others believe that education and incentives for eco-friendly practices could be more effective. What do you think? Is the EU on the right track, or should they consider other solutions? 🌿 🔖 https://lnkd.in/e9-NCBkK #EnvironmentalCrimes #Ecocide #ClimateAction #Sustainability

An article of mine in which I highlight the role of ecocide law in governance of local and global common resources, arguing that the apparatus provided by criminal law could lead to better clarity and enforceability of existing environmental governance.
“A new crime of ecocide, a preventative and all-encompassing framework, can rectify an existing taboo in international environmental regulation: the most serious destructions of nature are morally reprehensible and thus criminally liable acts. Ecocide law therefore holds significant potential to usher in a new era of environmental governance that can ensure exacting protection for nature, on Earth and in outer space.” Read the full eco-nnect article by Stop Ecocide International’s Legal Analyst and CEO of The Legal Pact Anna Maddrick here: https://lnkd.in/gzZMv8cR #StopEcocide

Whereas environmental crimes ultimately affect the fundamental rights of citizens, the European Union is firmly committed to prevent and control such crimes by ensuring a high level of protection, tailored to the diversity of national situations, applying principles based on precaution and prevention, at-source repairing of environmental damages, and abiding by the “polluter pays” principle, as well as cooperation and periodic reporting. #FironBarNir #attorneys #legal #advisory #regulation #compliance #environment #protection

I do agree with the article. There are already so many people who think all environmental claims are green washing and so won't purchase any of those products or services. If people don't buy them, companies won't make the products or offer the services--or if they do, they will be exponentially more expensive than they are now. We need to encourage people to be sustainable and not keep pointing out to them everyone who is doing it wrong. Let's focus on those who are doing it right.
I don’t agree. The Competition and Marlets Authority is helping business make CREDIBLE environmental claims - it’s not stopping them making them altogether.

The manner in which SCOTUS rules on this could start the reining in of the bureaucratic state. The Supreme Court will hear a dispute this week that could lead to a decision dramatically clawing back the power of federal agencies, putting a number of consumer and environmental protections in jeopardy. At issue is whether courts should defer to interpretation by federal agencies when a law could have multiple meanings, a practice known as Chevron deference. In practical terms, this means the court is considering whether to weaken the ability of a presidential administration to put forward regulations meant to counter pollution or climate change or to protect consumers without clearer authorization from Congress. #bureaucracy #regulatorycompliance #regulation #bureacrats #government #overreach
