The wire is IN 💸 The last 90 days we just doubled our money on a real estate deal. This was another foreclosure deal. $150k in and $300k back. That’s a 400% yearly return and capital back. What the guru won’t tell you is that the deal could have blown up 500 different ways. The entire deal was active damage control. Nobody would have put their money in this deal, so we put our own. Reinstated a loan and took second lien position Renovated the property for the owner Positioned the property for sale and refinance Ultimately repositioned the debt Created a win for everyone So how did we know this deal was gonna work? - Evaluated the owners character. Is this someone I can trust? - We got our attorneys heavily involved. Litigation attorney, real estate attorney. - We drafted very clear outlines and agreements - Communication was on point and constant Would this deal have worked for the next guy? Probably not, maybe The truth is I spent the ENTIRE deal focused on the downsides. At the end of the day the upside only hits for a moment and it’s at THE END. Had we not been focused on the downsides it would have gotten ugly fast on many occasions. Protect the downside, protect the downside, protect the downside…. Even woke up at 3:30AM this morning thinking about everything that could have blown up this wire today 😂 Truthfully I feel bad for the people who don’t know what they’re doing. Real estate can sting real quick when you don’t!! Off to the next one!

Congratulations Partner, Mark Anderson and Senior Associate Matthew Routh on a recent order issued! Previously, Shiryak, Bowman, Anderson, Gill and Kadochnikov LLP commenced a quiet title action alleging the mortgage was beyond the statute of limitations. However, the bank filed a motion to dismiss which was granted because the court viewed a prior ruling stating that the bank didn't have standing to accelerate and therefore statute of limitations ("SOL") did not expire. Despite the fact, there was never a legal determination on standing. With the recent passage of the Foreclosure Abuse Prevention Act, Mark and Matthew moved quickly to file a motion to renew under a new provision that specifically states that unless there was a dispositive finding of no standing that was the basis for dismissal, the bank has the burden of establishing they didn't have standing. Yesterday, the Court agreed with SBAGK and granted the motion to renew and vacated the dismissal as well as stay the pending foreclosure. This is a huge win and an excellent demonstration of FAPA's utility. #foreclosures #realestate #attorneys #lawfirm Attorney Advertising: Prior results do not guarantee a similar outcome.

A new investment opportunity has been listed on Invown by AHP Servicing, LLC and American Homeowner Preservation 2015A+, LLC, aiming to support their ongoing litigation with Cymbidium Restoration Trust and other entities regarding disputes over $60+ million in Mortgage Loans and REO Assets. The litigation stems from disagreements following a Loan Agreement and its subsequent amendment with Cymbidium, which included management and repayment conditions for certain Mortgage Loans and REO Assets. An alleged discrepancy in the final calculation led to legal actions by Cymbidium, claiming that amounts were still due on the obligation. In response, AHP Servicing and American Homeowner Preservation have filed claims against Cymbidium and its affiliates for a range of alleged legal violations, including asset misappropriation and breach of fiduciary duties. The funds raised on Invown will help cover legal and related costs as the case progresses. The target for the initial round is $200,000 by May 15, 2024, with subsequent monthly fundraising as required to support ongoing legal expenses. This initiative offers investors the potential for a 15% annual return, prioritizing repayment to Litigation Support investors before distributions to existing investors.
