Employment Brief: Clarification of guidelines on Whistleblowing Officers 🌬️ in Slovakia Given the multitude of information sources on the role of Whistleblowing Officers (WO) and their increasingly prominent role in leading internal investigations, a clarification of their roles is necessary. Here are the key points for your convenience: A WO should: 🌟 be an individual of high morale, good reputation and ethical standing, who is able to garner the trust of the employer's management as well as of the employees; 💼 have a suitable background, ideally in the field of law or economics; 🔎 have practical experience in conducting investigations, audits, controls or similar analytical work is welcome; 👣 have methodological and analytical skills to be able to identify potential breaches. The WO is strictly bound by instructions from the employer's statutory body or the statutory body of the parent company. From their part, employers must: 👉 facilitate the independent execution of duties by the WO; 👉 ensure no conflicts of interest arise; 👉 maintain the WO's qualifications up-to-date on an ongoing basis. ⚠️ Avoid potential scrutiny from the authorities! ⚠️ Employers should review their whistleblowing policies and relevant internal documents, as well as the qualifications of their current WOs to bring them in line with issued guidelines. 🗣️ International companies should consider appointing a WO fluent in Slovak 🗣️ Since the local language is preferred for filing notifications and communication with local authorities will likely be required, it's important for a WO to be fluent in Slovak. I’m sure many in the regulatory community are wondering about the impact the new Ministry of Regulation will have. From my perspective the early signs are very encouraging - it’s evident that it will incorporate and build on the work that has been underway through the leadership efforts of Treasury, MBIE and the regulatory community over a number of years on regulatory stewardship, and capability development (Government Regulatory Practice Initiative (G-REG); another signal is that the people stepping into the establishment roles clearly bring substantive relevant experience and knowledge; and this post itself provides a signal by reference to the importance of having “an experienced practitioner with operational understanding to join a team that will also be doing first principles analysis. Can’t do good policy work without understanding the operational side.” Well designed regulation, implemented effectively, is critical for New Zealand. The new Ministry, with the support of an active and engaged community of regulatory policy and practice leaders, has the opportunity to make a positive difference.
