Congrats to TIDA member, Heather L. Stover, Esq. from Ogden Sullivan Stover & Saar, P.A. on a great appellate ruling in Florida that deals with violation of the FMCSR against hand-held cell phone use and the entitlement to punitive damages. In short, the trial court granted entitlement to punitive damages. The 6th DCA in Florida reversed, finding that the violation of this regulation or use of a cell phone alone is not sufficient to be entitled to punitive damages. There had to be an additional act that showed the use of the cell phone was reckless or a conscious disregard.
