Last week, I mentioned the Family and Medical Leave Act (FMLA) while going through the nuances of the NJFLA. This raises an important question… Does FMLA Leave Count Against NJFLA Entitlements? The Family and Medical Leave Act is a federal labor law requiring covered employers to provide employees with job-protected, unpaid leave for qualified medical and family reasons. When an employee takes leave for a reason that is covered both by the NJFLA and FMLA, the leave simultaneously counts against both types of leave. However, employees who take FMLA leave for their own disability are entitled to an additional 12 weeks of NJFLA leave within a 24-month period. For example, an employee who first takes FMLA leave due to their own pregnancy—or childbirth-related disability—would be entitled to an additional 12 weeks of NJFLA leave in a 24-month period to care for or bond with their newborn child. Importantly, if an employee is on FMLA leave and a subsequent event occurs that renders the employee eligible for NJFLA leave, the event will not convert the FMLA leave to NJFLA leave. In addition, the leave time will NOT be simultaneously counted against the employee’s NJFLA leave time. I hope this clears up the confusion! What do you do when FMLA, ADA, and a PIP all combine? Can you fire someone in this case? A reader found herself in this situation and asked this question over at Comstock's Magazine I’m new to Family and Medical Leave Act management. Employees can have up to 12 weeks unpaid, job-protected leave under FMLA, and I have an employee, Marge, who is approaching her 12 weeks out due to anxiety and depression. Before leaving, she was written up for her poor performance, and she said it was due to her condition and being old. Her words — not mine. She was also told she would be going on a performance improvement plan. However, before that happened, she left on FMLA. She did see the PIP but refused to sign it as she didn’t agree with it. She was due to return a month ago, but after follow-up with her doctor, she is now scheduled to return at the end of this month. This date goes beyond her 12 weeks.
